The lawyer BS continues...

The lawyer BS continues...

2nd Rider came back today stating if in the event after contract that an issue becomes of the deck, fence, shed or stairs that the seller will pay half the cost to remove it. (no cap)

My commitment is from a lender who I've spoke to many times (and even some LIW brides here used them and agree) that we will be able to close with a survey enoorsement and CO of the house only.
Without regard to the above items.

After contract, there is no out for us. We would have to take on each situation as it comes - whatever that may be and deal with it.

Guys, you know I've looked for many months and saw *a lot* (regardless of number) houses and this is THE house is the area I wanted.

It seems a little rough right now, but if you really wanted a house would you remove whatever it was (ie: a shed) these things can born torn down for cheap.

I feel so frustrated through all of this - and these people are so annoying...

I know to rebuild whatever needs to be taken down is expensive...but that doesn't effect us being in the actual house. We can replace a fence over time etc.

How do you feel about this?

I am not a lawyer so I won't comment on what you said above. But as far as this goes....

Ask yourself this.... if this was the FIRST house you saw and you actually went into contract and had to deal with all this BS... would you have the same view?

It sounds to me like since you saw so many houses... you are 'settling' on this one and are willing to deal with a bunch of bullshyt that really isn't necessary.

If it were me... and I wasn't comfortable with the terms of the riders... I would look for another house.

The worst thing somebody can do during a house deal is to let their emotions get involved.

I agree (as unlikely an occurrence as that might be ). If you don't like the terms, don't sign the contract. I realize you've seen over 100 houses...but it seems as though if you would have done a bit of research before you went you would have never gone to see them to begin with. There are more than 100 houses on this island, and jumping into buying a house b/c you really want to have one is the wrong decision.

I totally agree with you. I'm trying to use the brain not the heart. This house is so much potential and what we consider ' a sweet deal'.
It's not that I'm settling due to exhaustion - although I am exhausted but mostly about worrying about my wedding - it's just that the things I'm worrying about can be removed - they are not permanent. The house itself is truly what I'm after...and the location.

we did do a bit of research. I've already addressed this issue in a different post. We knew/researched what areas we wanted and looked at anything of mls that had potential over a span of 4-5 months. Being dedicated isn't a negative thing - it only makes you smarter.

if you really want the house and you know what you are geting yourself into, then do it. I hope it all works out for you.

I hope your intentions weren't to be mean with that comment.

My intentions weren't to be mean at all...just that if you don't feel as though this is the be all end all house for you, then I would look for another.

I didn't read your other post, so I don't know much about what you've done to buy a home. All I know is that 100 houses in a short period of time seems like you hadn't narrowed down what you were looking for before heading out to see houses in such a short period of time.

Sometimes it takes a very long time to find the house that you want, and that's not a bad thing. It's a very big decision, and it shouldn't be taken lightly. Don't rush into anything.

Well, these are my feelings!

1. You mention that it is a 'sweet deal'. Will it still be the same sweet deal when you have to pay for removing all of the items, and deal with all of these extra issues, and replace them later on? I know you said that you will replace after time, which is fine; but the way I look at it is that you shouldnt need to..

2. The same 'sweet deal'. Would you get a better interest rate if you had COs? The house we are purchasing is missing some COs; I called my broker and they said they can move my loan to another company that would overlook it. But it would raise my interest rate by 1%. (And both my husband and myself have credit over 800 and no other debt). Have you seen what other rates you can get if it did have the correct paperwork? Are you willing to pay for this extra 1% for 30 years? Do the math, you might be surprised.

3. Appraisal. The mort company will need to do an appraisal before they committ. Will the house still appraise for the same amount with those structures removed? I'm not exactly sure what will happen if it doesnt, but I think if it is off you need to renegotiate, or pay the difference.

4. Why won't they get the COs? Is there a bigger problem here? Is their rigidness on this fact a precursor of what you have to come?

5. Have you had engineer/termite check yet? All of the above, plus a sketchy engineer plus termites might put you over the edge.

Either way you go, good luck.

I have no experience with COs since I have only bought co-ops.

But judging by what people here have said... COs are a PITA to deal with. This is something I would get the seller to deal with.

Threaten them with this. Tell them to deal with it or you will walk. Maybe they will give in. If they do... you will feel much better.
