Update! Please help cancellation question?

Fiance and I decided that we are going to still use the caterer since we can't get our money back and we are just going to downgrade on the contract. This scare put our lives into perspective as far as money. Being that I lost my job about a month ago and Fiance business is not going so well. I am going to take the simplicity of the farm and keep it that way. I wanted a very informal wedding but somehow I ended just adding more and more things. So crazy as it sounds we are going to speak to the caterer again and ask him to supply the food and servers and we will handle the rest.

For all the Brides who wrote to my post...
Thank you all for your words!

Basically that means that, if you cancel, anything you've paid so far is his. If you reschedule the event or another event within 90 days of the wedding date, he'll use all of the money you've paid so far - except $500 - towards that new event

I should clarify that the new event is catered by him, not someone else

ARRRGHH!! I'm so mad for you!!!! up the price? What is this nonsense. I think he should honor the price he gave you!!!! Where are people's integrity?!?!?! If it really comes down to it, I would check with a lawyer. If he quoted you the orginal quote in writing he may ahve to honor it even though it says in his contract that prices are subject to change. IDK, I'm not a lawyer, but I do know that just because something is in a contract doesn't make it completely binding if there is already a law that says otherwise.

That part ...'Less $500'... sounds like your deposit and prepayments will be applied towards your balance, unless you reschedule with him within 90 days of the original date. If you reschedule he will apply all that you have paid except for $500 which he'll keep for himself.

I hope that makes since...

I'm still so angry for you... I hope it works out!!!!

Keep us updated! We are crossing our fingers for you. What reasons is he giving you for uping the price?

i hope you get out of it! i don't know, i'm not good at technical contract-type questions. but there's no way he should be permitted to just change your price. i'd def consult a lawyer. i think it'd be worth it.

I think I am about to cry....
I haven't had any real problems with vendors until now. With our off-premise caterer. For a few days now I have been feeling iffy about his service. I went over the contract just a little while ago after watching bride trial on Judge David young. I haven't heard from him in a few days and then I just checked my voicemail and he is telling me that needs to charge me more!!!!! what!!!!!!

I feel like I want to cry and scream!!!

So i looked at my contract and it says something like all costs are subject to change...okay
cancellation policy I don't quite understand it....can someone help.

it says: all prepayments and deposits are forfeited if you, the client, cancel the event at any time. Caterer will apply the entire balance of your deposits and prepayments, (this is the part i don't understand) Less $500 towards another event occuring within 90 days of the original event date. Subject to our availability.

Please help any advice appreciated

Ok here is my advice, if you already paid to much to cancel with him, then tell him that if he wants to run a business that is sneaky like that then you will let a forum (like this one) know exactly what his business practices are about. He's not going to want to give his business a negative look so at the very least he will not increase price anymore. Try not to stress. I KNOW easier said than done.

I agree, definitely consult a lawyer to find out what your rights are...perhaps a lawyer can write a letter on your behalf at least!!! Scare the caterer a little...and def tell him you will be waiting for his response along with many other engaged women!!!!!!!!!!!
