UPDATE WITH AWESOME NEWS!! REPOST from BHB: ARE THERE ANY LAWYERS ON THIS SITE?

Originally I was not going to post what this is about but I need advice from a legal prospective.

Back in Feb. FH and I purchased our weddings bands. It took until April for my ring to come in b.c it was a special order. At the time I made the purchase I was not making the best decisions due to family illness's etc, and I know the retailers don't care about that stuff or need to hear it.. but it's the truth. Their policy is no returns or exchanges after 90 days of purchase. I knew that when I went to the store yesterday but the sales rep said it was ok, they would accept the exchange as long as we do an exchange of equal or greater value and the exchange items would be final.. Fine, we left yesterday and told them we would be back today. We made sure to have them write this on our receipt and sign it! FH and I went back today as planned to do the exchange.. and we were told that the District Manager called the store ( the DM is in their Queens store) and said that they will not allow the exchange. Ok.. so why did they tell us just yesterday that they would allow it and write it on the receipt as well and now they are going back on the aggrement?! Now I know they are right about the policy issue BUT the fact that they said they would make an exception and told us we can, we have written proof and now the DM tells them not to accept the exchange is just wrong! FH is going to the store where this District manager is to speak to her in person and fight it.. and show her our receipt where it's a written aggreement.. I just wanted to know from a legal standpoint, if they can get away with this?! Thanks ladies

PS I asked the sales rep that we dealt with originally if this news was given to you this morning, WHY did we not receive a phone call with this news right away... I got a run around answer...

why do you want to exchange it, are you going to get a ring worth more than the one you have? I am sorry you are having trouble but from what I remember in business law, it seems like they would need to honor what they wrote on the receipt (as long as you did not hold a gun to their head while they wrote that)

good luck

JMJBride is an attorney but I think she concentrates on employment and labor law. FM her, maybe she'll have some general knowledge.

I would go right over the DM's head. If this is a corporation, all you need to do is get in touch with the corporate office and read them the riot act. Threaten bad publicity, etc.. They will give you what you want. If you really need to bring out the big guns, find out who the president of the company is and fax them a letter regarding the unprofessional treatment you are receiving.

I'm a lawyer, but I'm not sure how much I can help you. The problem is that the store has a policy and only certain individuals have the authority to change that policy or make exceptions to it. In other words, despite what the sales clerk told you, he/she may not have been authorized to agree on behalf of the store to exchange your ring.

This is not my area of the law, so I'm not sure if I can offer any more assistance. I think your best bet is to try and work it out with the store or district manager. You could also contact someone who is their supervisor, as Faith suggested. Retail stores will typically respond to you if there is the prospect of a lawsuit because it costs more for them to litigate than it does to comply with your request. My guess is that the 90 day policy has to do with wear and tear on their merchandise. If I were you, I would make the argument that even though 90 days has passed, you have not touched or worn the ring. You may be able to persuade someone that, based on the condition of the ring, you should be excepted from the 90 day policy.

Bottom line, it's up to the store. If you can't work it out with the manager, ask for his/her supervisor and so on. Best of luck!

Good news!!! FH called earlier. He went to the store in Queens where the District Manager is located spoke to her and showed her the original receipt where it was handwritten yesterday by the sales rep in Huntington that we CAN exchange the ring! The DM made a call to her boss and after she got off the phone she said the situation has been resolved and we can move forward with the exchange! YAY! I will tell you what though.. I am not having FH buy me anything from there in the future though!

They HAD to honor the receipt! You were RIGHT SSDK!! Thank you so much
and thanks everyone for their advice.

Glad it worked out. In my opinion, you, the customer reasonably believed that the salesperson represented the store and had authority to make such decisions. The store should stand behind it and if they don't want the salesperson to do that again, it's not your problem. Yay!!!! Can you FM me with the name of the store? I am curious if it is the place my rings came from. I understand if you don't want to say.
