UPDATED!! NWR: Bank Vent (Anyone work in a bank who can give me advice) Sorry So Long
I am so mad right now. I live in an apartment building in Westchester and our building is run by a management company. Apparantly 8 months ago the management company lost my rent check and it miraculously showed last week. So without letting me know (i know they don't have to but still...) they deposited the check and my bank (God only knows why) decided to cash it. Well now my account is overdrawn and I didn't know about it because I got paid on the 30th and deposited some extra money so I knew I could use my debit card since their was (or rather was suppose to be) money in my account.
Now my bank is trying to charge me over $600 in over draft fees. HELLO!! They should never have deposited an 8 month old check in the first place. I've been arguing with them for two days and have spent over 2 1/2 hours on the phone with them. A Supervisor is suppose to call me back tonight. I mean I know I wrote the check (8 months ago) and I know that the bank has the right to cash it but seriously being that it was that long ago they should have opted not to cash it, especially since it was the week after Christmas and I didn't even have the money in my account to cover the check.
So if anyone of you ladies works in a bank and can give me some advice on how to get most of overdraft fees back I would really appreciate it.

Sorry to hear that, I would be sooo pissed too.
You should also contact the management company and tell them they should pay you back the fees since I'm assuming they told you that they lost the check and then decided to cash it 8 months late. They should have checked before cashing it now.
Hopefully it works out with the back, but I would definitely also yell at the management company.

I check my account religiously and if my rent check was never deposited in the 2 weeks after I sent it, I'd've been all over that way back when.

I called the Bank (their 800 number). That's how I always deal with my bank by calling. Should I go in person? I didn't dispute the cashed check, I was trying to get them to waive the over draft fees. According to what I've researched. It is in the bank's discretion if they want to cash a check past 6 months. They don't have to but they can.

that is true - the bank has the discretion to cash checks over 6 months old

So did you get charged twice for rent then? Because if thats the case then i'd take it up with the management co.
Sorry you have to deal with this. I know how you feel.

I don't think going back in time is an option here...
If the bank has the discretion to cash the check after 6 months, there is probably not much you can do. However do you have that money in another account to cover the check?? Maybe if you move money immedialtely into the acct and go in person to a branch they can waive the fee. Usually dealing with an angry customer is harder in person...they are more likely to waiver and remove the fees! Good luck!!

Yea, I'm pretty sure it's up to their discretion. Just try and be nice, remind them that this has never happened before. Hopefully none of your checks have bounced so you don't have to pay people back the fee!
Sorry you're going through this!!!

Sorry to crash...
but i work for a bank. And they have up to a year to cash a check unless it says otherwise. (most companies will put a date) but personal checks are again good up to a yr.
after they 'lost' the check did you give them a new one?
and next time when someone tells u they lost the check go to the bank ASAP and cancel that check number.
sorry this happened. is this your first time? sometimes they will give a one time free-b.

Didn't you notice that the money for your rent never came out of your account 8 months ago? I don't know how that's possible. It's technically kind of your fault. You never paid rent that month, kwim? It stinks that the check just surfaced and its cashing caused your account to be overdrawn, but it's not really the bank's fault here.

I did know that the money never came out of my account and I figured I would give them a couple of months to deposit so in July I was going to put a stop payment on the check but with all the craziness of the wedding planning and meetings I totally forgot about it. It was an oversight. I'm not blaming the bank I know it's technically my fault but in the same respect they cashed a check for a pretty decent amount of money that was 8 months old and the funds weren't in the bank at the time they cashed the check. Not to mention the fact that every time I used my debit card (after my account was already over drawn they didn't decline the purchases and let me rack up $600 in overdraft fees. This was all in a matter of 3 days. FYI I didn't know the account was overdrawn because of the NYE weekend I didn't check my account and this happend NYE so on Monday when I checked my account is when I noticed the problem)
Its just very frustrating. This is the first time (in 8 years that I've had this account that this has happened)

My fiance and I also work for two different banks and both of our bank policies are that a check is considered stale dated after 6 months. However, it is a bank discretion if they wish to cash it up to a year. I would go to your branch, speak to a manager and double check what their policies are about stale dated checks. They might be willing to work with you on the fees. I also agree with what someone previously wrote about if you sent in a replacement check for the rent considering they took forever to cash the first one. If they cashed both checks then they are at fault. Did you do a stop payment on the original check?
Good luck

Going back in time is only an option if I had Doc Brown, a Delorean and a Time Flux Capicitator.

The way I see it, if you're gonna build a time machine into a car, why not do it with some style?

I used to work for a bank and I think you should def go to your branch in person. They should be able to reverse most of the charges when you explain what happened. Good Luck!!!!

Re: NWR: Bank Vent (Anyone work in a bank who can give me advice) Sorry So Long
I had a similar problem but i stopped payment on the check so i had something to go on (which was huge bc the credit card company ended up reversing late fees, stop payment fees, and made sure that it would not affect my credit).
I would sweet talk the bank, you never had this problem before, miscommunication with the management company etc bc the bank is the one who can and hopefully will reverse some fees.
and although theres not much the management company can do to change anything at this point, couldnt hurt them to know how unprofessional it is to lose a rent check and cash it 8 months later without so much as a courtesy call (when rent is a huge percentage of people's income)
so frustrating good luck!
