updated - she got her $$$

Original post by Shorty McBride

My best friend just broke off her engagement.

It's a rough time, but she made a very good decision, and I'm proud of her.

Unfortunately, she already booked the Inn at East Wind for July 4th, 2006 (it's a tuesday), and they will not return her deposit ($1300 ) unless someone else books the date.

I feel HORRIBLE for her...she's fresh out of college, and what she thought the rest of her life would be is now COMPLETELY different than it was a month ago. I can't even begin to imagine how she feels.

Please, please, PLEASE spread the word to any brides-to-be that haven't booked a place yet!

She got a GREAT deal for that day too - she upgraded to viennese, and some other food choices, and it was UNDER $100 pp INCLUDING tax & grat.

Thank you, in advance, for helping in any way.

Please spread the word!!!

Book 7/4/06!

Re: updated - she got her $$$

nope... if you cancel more then 6 months in advance it is presumed that they rebook, there for they HAVE To give all but $100 back!

from above:

If you cancel with a Suffolk County catering hall more than 6 months before your date you can get all deposits but $100 back.

If you read the subdivisions together, 237-3 (3) and 237-4 'prompt refunds', because rebooking is presumed if the date is more than 6 months out, the hall must return the deposits within 30 days of being notified of the cancellation.

Because rebooking is presumed you DO NOT have to wait 30 days after they rebook.

send them a letter in writing, (make it certified so you know they receive it) citing the law stated above, and that if you do not receive your money back you will be contacting your lawyer...

The info IS correct
Don't call East Wind....WRITE A LETTER, stating that you spoke with 'so-and-so' on 10/27/05 and cancelled 10/27/06. Blah blah blah, you're aware of the law that if a hall is cancelled with more than 6 months to go, all they can legally keep is $100....etc. Make sure that you go to the post office and tell them that you want the letter sent certified mail, RETURN RECEIPT. You'll get a little green card back in the mail when someone signs for it at E.W.

I would NOT contact E.W. by phone - you already cancelled 2 MONTHS AGO! Just wait til they get the letter. Once you get the green return receipt card back in the mail, THEN go ahead and call E.W., inquiring about the status of your refund check.

good luck hun That's YOUR money!

That's terrible. My hall told me about the cancellation policy before I signed the contract. Just goes to show what a great choice I made. Sorry I just love my hall

Maris...if you read the law quoted on the first page it clearly states that it is presumed that if you're cancelling 6mths or more prior to your event date (which you ARE) rebooking is a giving... YOU ARE ENTITLED TO ALL OF YOUR MONEY MINUS THE $100 NOW REGARDLESS OF E.W. REBOOKING OR NOT.

Definitely reread the first page of this post. Don't let them bully you. The law is what the law is... Good luck!

Re: updated - she got her $$$

I called consumer affairs....You guys are right! Im owed that money less of 100 dollars!!!!

Apparently east wind has 3 cases against them for the same thing right now...all of which were won and the money was retrieved!

I called east wind yet again...trying to handle this privately and civilally....Apparently they have to call me back

In the meantime my letter was sent certified today...and if I dont hear back from the today, Im going to have a lawyer type me up a letter and send it certified as well... Then off to file with consumer affairs I go!

Re: updated - she got her $$$

Does this law apply to outside of Suffolk county? Nassau county for instance and if so, where can I find it. Please help!!

I cancelled with a Nassau county hall more than 6mths before the date I gave them and they are yet to return my $2,000 deposit.

If anyone knows anything for Nassau county, please help.

bump...anyone knows??

Shorty McBride Posted:

Re: updated - she got her $$$

Nope, this law is a SUFFOLK LAW ONLY.

...BUT depending on the nature of the cancellation (ex: if the hall did something that was not up to standard, etc.), you may be able to fight them to get some $ back. If you just cancelled because you liked another place better, or you realized it was going to cost too much, etc., you're not entitled to any $ back in Nassau.
