****UPDATED:CALLING ALL LAWYER BRIDES/GROOMS

I'm am i a bit of a situation.

The dress that i wanted originally was to expensive so i went to a dress maker to get the dress made.

From the first time I met with her I said I didn't want pearls on my dress at all.. She said don't worry about it, I know what you want Great wonderful fine.. I went back for my fitting after the 'beading' was complete to find that the whole bodice, train and a bit in the front was pearls.she said she had them do it in the beads that i wanted first and it didn't looks good(I know she is a designer, but i am paying for it.. it should have been my decision not hers) I was not a happy camper..she said don't worry..i will add sparkle to it and you will like it... i left the place in tears b/c i wan't happy..but i went along with it.. I called her a few hours after I calmed down and explaind that although it is a beautiful dress, i wasn't happy.. she said don't worry i will send it back out for more beading and you will like it... so she convinced me that i will like it.. now almost 3 weeks later i haven't recieve the sample of beading that she promised me.. so i called her the other day and asked her what's going on with the sample and beading.. she said b/c it is comming from India it takes alot of time(mind you she is not having them start the beading on the dress without my approval of the beading)... i asked am i going to get it in time.. she was like i hope so.. don't tell a bride I hope i get your wedding dress in time for your wedding.. I asked her if i needed to make alternate arragments and she said no no don't worry it will be here..

Now that this is not really the dress I want.. and it may or may not be here in time.. Will it be an issue if I ask for my deposit back?

***********UPDATE*************************
I went to her yesterday and she signed my original contract saying that she will refund my deposit back on May2..

The most important question is...do you have a contract. It should address that issue.

If not- it will be difficult to get your deposit back because she did put labor into the dress.

My SIL took her dress designer to small claims court b/c she ended up buying a dress /c the designer didn't do what she wanted. She also sued for the return of her payment.

She didn't have a contract and lost because the designer did make the dress and put labor into it. But her other problem was the fact that she didn't try on the dress the last time after alteation- which the judge found to but her mistake- not the designers.

I hate to say this, but even though you say 'she convinced me,' you've thus far approved the further work on the dress.

If you want a new dress, though, or want it changed to exactly how you want it, you need to be assertive, take no excuses, and do this NOW.

I have a contract and it says beading not pearls..

i also have picture to show that i have tried it on in it's various stages.. and she assured me that I would have th dress i want..I also have witnesses to give proof to my story. I also have the pictures i cut out and showed to her that had no pearls on it.

As of right now she was to get me the samples and 3 weeks later has not come up with anything..

She is being very unprofessional.. i had to call her and keep asking if my dress was in.. she not once called me..I called her to make appts to try the dress on.
