What happens if you put a 'must appear' clause in your contract and the member does not show up?

I saw another bride state that she put this in her contract, to make sure that the key person of the band would be there. I was wondering is there some sort of 'penalty' that the band would face if that person does not appear?

Oh, okay! I don't have a band, so I can't help you (sorry). I would assume there would be some sort of monetary compensation if they guarantee you someone and they don't show up.....

I know exactly what you mean. When I went to Duet Eric said that he would be doing our wedding. I'm not sure about the band situation but if the reason you wanted to go with a particular band or vendor I think it's important for you to have it stated in your contract. We wanted to have a steel band vendor from the Lovin' Oven showcase we went to and would love to have the same guy ( my fiancee thought he was HOT ). So we kinda fall into the same situation as you do. I'll keep you updated. They may say he's sick or something to get out of it.
Best wishes,
THomas

You should get all of your vendors named specifically in your contract. They can claim illness or family emergency to get around it, but that's just shady business. I don't think someone would be a no-show for no good reason. As far as bands go, most bands have been together for a long time and they don't swap out people unless it's weird circumstances, which you should be notified of before-hand and something can be worked out.

Not necessarily true about the bands. being a musician, I can tell you how flakey a lot of us are. If it's not a really top wedding band, a lot of times there are many revolving doors with these bands. I would try to get as many of the names in the contract as possible. I'm sure if someone stated in a contract they would be present for your wedding, and then were not, you could take them to small claims court. But then again, I would only do this if someone different showed up AND I was unhappy with their work/performance. JMO.
