What would you do if there was a mistake in the contract?

What would you do if there was a mistake in the contract?

Our lawyer didn't cross out air conditioner, so our contract states we are leaving our very expensive AC. The buyer of our apt. knew we intended to take it. Our lawyer mistakenly didn't indicate the AC was not included.

My question is two part:

If you were the buyer would you hold the seller to the contract?

Also, we told the lawyer to take it out, I am wondering if he will do something for us to reflect this error.

Any thoughts.

It really is your lawyer's fault and he should try to explain it to the buyer's attorney and amend the contract in writing, OR give you a break on his fees to protect his A$$ so you don't sue him!

But in any event, if I was the buyer and honestly knew that the A/C was not included, I would NOT hold you to that. If I thought the A/C was included, I might.

Yeah... i doubt they will put up a stink about it. Their lawyer would probably just tell them it wasn't included and it was just a mistake. Lawyers tend to 'back each other up' in situations like this.

If they put up a stink about it... just replace it with a cheaper AC.

Our sellers removed things that they should have left, but in the big picture it just wasn't worth the stink after we found out when we got to the house after closing. It was stuff like a bathroom mirror, decorative curtain rods, etc. They also had no exclusions on the listing which we took into consideration when we made our bid, but added a chandelier as an exclusion into the contract. Again, we figured it wasn't worth the fight.

We can't replace the $$$ AC, it has to be what is in the apt. presently. The buyer is being a jerk about the whole thing. It looks like we have to leave it.

And to think I was going to leave him a good luck plant!

Thanks for all your responses, apparently all of LI isn't the way we think.
