Where are all the lawyers?? I need some help!!

I was forced to resign from my job. Fine, I am over it. However, I did not receive my last paycheck because they said they made a mistake on it. My job ended two weeks ago and I have yet to see my paycheck. I really feel they are holding out of spite. They keep telling me they have to wait to run another payroll before they can cut me a check. I was told they were doing one early this week and I have yet to get a check. I am really getting ticked off now, I have bills that need to be paid and I need my money. Is this legal what they are doing? I technically don't work for them anymore and I feel I am entitled to my paycheck. Do I have any ground to call and threaten them that this is illegal and I want my check? I am not contacting a lawyer, but I want to threaten them in hopes of getting my check. I was advised that I have a good discrimination case aginst them because of they way they forced me to resign and I have decided not to pursue it, but I feel like the only way I will get my check is if I threaten them. Help!!

I suggest you DO pursue it. They should not get away with treating you or anyone else like that.

I am not an attorney. But I doubt very much that they have to wait for another payroll cycle to correct a mistake on a check issued on another. I say retain an attorney and go in there with guns blasting. That is such BS!

I am an attorney, but I don't know the legal resposne to this from my work.

However, as a person with common sense (at least some of the time), it is clear that you are entitled to your paycheck that you earned while you were employed there. You can definitely threaten to sue, and you can even bring an action in small claims court. They definitely owe you the money. You earned it. If you decide to pursue an action, I can tell you where to get the forms.

Sorry you are going through this.

Well, I just called again and they told me I won't have a check until next thursday. I said no, that is unacceptable. I told the woman, they took my summer school job away because I was not part of the district anymore, there fore since I am no longer part of the district I want my check. I told her that I have rent and bills to pay and I am not waiting a third week for my check. I told her that I was advised by my union that I had a case against them and I decided not to pursue it, however, if I do not get my check by tomorrow, I will be contacting my lawyer. She told me that she will call me back and see if they can push it along. I am soooo pissed. I feel bad calling this lady because she is actually the mother of one of my brother that dieds friends. I tried to be as civil as possible, but I let her know that i was mad and unless i get my check tomorrow, I get a lawyer. So, I guess we'll see from here.
And besides that, next thursday is my birthday and the last thing I want to do on my birthday is go up to that place and see the asses that did everything to me!!

Thank you for the advice! I have been on the Department of Labor website all morning. I read that this is illegal what they are doing and I have downloaded the forms necessary to file the claim. I still have no check, and I am waiting for the woman to call me back one last time before I go and file my complaint. If the superintendent didn't get his check, I am sure they would find a way to get him one, so why not me. I truly hope I get my check today, although I am doubtful.
