Re: Who Here is a Legal Secretary....

Oh boy - I have a ? for you guys. FH has a lawsuit pending. Today he was supposed to go to 'examination before trial'. His lawyer cancelled because he is sick (he was still in the office and told FH 'would you want someone representing you sounding like this?') ANYWAY... so far these people have lost his file for 2 years and now after 6 months waiting for the examination b4 trial they cancel and he has to wait another month-2 months before he knows when the next E b4 T is. We are fed up with them!!! If we went to a different attorney would he have to start over from the beginning??????

kptoys, I'm not sure. I would think that if you change attorneys, they will need to know all of your information from the beginning. But what exactly do you mean from the beginning? The new attorney will need ALL information regarding your FH's case. I believe it is possible for them to take over a case, but like I said, I'm really not sure. Hopefully one of the other ladies can help you. Sorry.

Hope everything works out for you guys!

Re: Who Here is a Legal Secretary....

EBTs get adjourned all the time....it can be either side's fault...the 2 month adjournment is standard (at least where I've been)...they have to schedule it when the atty has available time and isn't scheduled to be in court or something...

You wouldn't have to start from scratch necessarily if you changed attorneys because the case is already filed in court but you would be subjected to the new attorney's schedule.

Oct - I mean like alerting the other side to the case and waiting for a reply and such. Waiting for years like he has been (4 years)

I have no idea about these things.

hmm... I'm not sure. I would think you would have to alert the other side because I believe each side's attorney needs to speak with the other. I wish I could help you more... my bosses door is closed right now...

The case should just carry over to the new attorney. The other side's attorney should be made aware of whatever changes you are making.

Re: Who Here is a Legal Secretary....

If you found a new lawyer, the new lawyer would send a 'Consent to Change Attorneys' to the old lawyer and they would sign it and send it back w/ a complete copy of the file...then the new lawyer sends the other side a copy of the completed consent so that they are aware of the change.

Really thats it!!! And things could continue as they are now!!!

The only reason I think FH wants to change is these people have been d*cking him around for 4 years. Loosing his file, not calling back and now this.

Thanks!!!

Just make sure that the atty you go to isn't as bad as the one you're leaving....and realize also that the court system is so congested that things can take a while, even with the best attorneys.

Good luck!
