Annoyed!! a long vent

Annoyed!! a long vent

So DH and I own a condo and our upstairs neighbors have twin two year old boys. Obviously it is not an ideal situation, but it has been so horrible lately. Anyone who is friends with me on facebook can probably tell I have turned into a very angry rage-a-holic b/c of these people. I understand living underneath someone means that I will occassionally hear footsteps but it is so much worse than that.. it is the two kids running back and forth constantly from 7am-9:30pm every single day. Even on weekends. I have to wake up 7am on weekends because of them and I am just not happy about it.

Anyhow, since we have lived there (2 years) DH has rang their doorbell 5 times to say it was way too loud.. only 5 times. We have complained to the baord about the noise and asked for additional sound proofing and were told there is nothing they can do, but that we would have to compromise amongst ourselves.

Well I come home from work last night to find a note taped to our door from them upstairs saying that they are not going to change their way of life for us, that they are not going to stop their kids from playing, that its our fault for buying the first floor condo and never to ring their bell again. Mind you, DH is not confrontational and never once was mean to them. He simple asked them to quiet down 5 times.. and very nicely. So i read this last night and my blood was boiling

Of course I wrote back and basically told her that our house shakes, its not just light footsteps, it feels like an earthquake 24-7. I cant even display our wedding china bc a peice almost broke from the walls shaking. I tried to explain that they also live in a condo and they have to realize its not a house and they have to have respect for their neighbors as well.. and that i never once asked them to stop their kids from playing or to change their way of life. I actually really tore them a new one in my note because I was so pissed off.

I just hate not feeling comfortable in my own house. I hate not being able to relax and just nap or watch tv.. and I hate having to fear running into them.. bc if i do i think i might lose my mind and flip out. Its such a horrible situation and its even caused fights between DH and I recently. I need out

Sorry for whining. I really really needed to vent.

I would pull out the rules of your condo group. My guess is there is some sort of clause in there about quiet living and such. If there is I would be right back at the board complaining. I would write a letter to the board and send it certified. If there is a clause in the condo rules then you could sue if you really wanted and I would make that clear to the board. They will most likely get involved if they know you are serious about it.

We had an upstairs neighbor that would let their kids run around and we complained so much our LL evicted them. I know it will be more difficult with a condo association to get them to react but be strong with them

I read and re-read those damn rules so many times and I can't find anything. Its a really long book thought so I could be missing it but who knows. I have spoke to the owner of the property so many times. Wrote him a letter and called him. He actually had someone come over to look at doing more sound proofing and they figured out it wouldnt make a difference. The owner told us that he called the people upstairs to talk about ways they could help compromise and they wouldnt budge. He called us back and was sincerely apologizing tell us that its a shame they will not compromise and that they are being so stubborn and spiteful and that he is going to have the president of the baord talk to them as well.. but he cant think of anything he can do unless they are willing to compromise.

ETA: he was even willing to put in FREE padded carpeting for them or to reinforce the loft in their condo to make it a kids play room and they said no to both.

Yea unfortunately the times we told them it was a little too loud they actually got alot louder. So we realized they were doing it to be spiteful. I was so upset last night because I never once asked them to not allow their kids to play and I never would. I understand two year olds want to run. I basically told them that but I dont get why they have to run around the bedroom above us at 7am every weekend for an hour or two when they KNOW we can hear it. Why not make them play in the damn living room! Stuff like that is just eating away at me. Last weekend i was hysterical crying for an hour because the noise was so so bad I couldnt study for my exam I had this week.

They are obviously being spiteful.
Me, I'd be spiteful right back. Play extremely loud music right up until 11 pm, or things like that. That's just how i am.

I know a landlord can start a holdover action against a tenant for excessive amounts of noise but im not sure if a tenant can start an action against another tenant. I would look into this though.

I do.. and I have.. but then I get headaches and realize im making it worse but on the weekends I usually blast the music and clean as a way to calm down. So at least we always have a clean house now!

I think you need to be loud late at night when they are sleeping. Or in the early morning I'd call the cops on them.....tell the cops that you think its a domestic dispute.

alli3131 Posted:

Re: Annoyed!! a long vent

also check your condo rules for a clause about floor covering. Usually they have to have a certain amount covered by carpet.

I cant believe there isn't some sort of quiet enjoyment clause in the rules....keep looking. If you can find something then the board HAS to react. We can always right a letter from an atty for you.....I will volunteer my services....lol.

Well then in that case I would not hesitate to call the cops. You can tell them that you want to stay anonymous and that way they wont be told who called.

I found this article and it does say that condos can do this against their tenants. I only dealt with landlords starting these actions against tenants so im not sure if a tenant can start a holdover against another tenant. You would definitely need solid proof that the noise is making your life unbearable such as taking pictures of any cracks on the walls that were made from the noise and even written letters that you sent to your coop board. I sent DH a text because he still works in that field and does more court work involving that.

DH just told me you would have to file a complaint with the board of directors and they can start the holdover.
