Annoyed!! a long vent

Original post by JennyAPH

So DH and I own a condo and our upstairs neighbors have twin two year old boys. Obviously it is not an ideal situation, but it has been so horrible lately. Anyone who is friends with me on facebook can probably tell I have turned into a very angry rage-a-holic b/c of these people. I understand living underneath someone means that I will occassionally hear footsteps but it is so much worse than that.. it is the two kids running back and forth constantly from 7am-9:30pm every single day. Even on weekends. I have to wake up 7am on weekends because of them and I am just not happy about it.

Anyhow, since we have lived there (2 years) DH has rang their doorbell 5 times to say it was way too loud.. only 5 times. We have complained to the baord about the noise and asked for additional sound proofing and were told there is nothing they can do, but that we would have to compromise amongst ourselves.

Well I come home from work last night to find a note taped to our door from them upstairs saying that they are not going to change their way of life for us, that they are not going to stop their kids from playing, that its our fault for buying the first floor condo and never to ring their bell again. Mind you, DH is not confrontational and never once was mean to them. He simple asked them to quiet down 5 times.. and very nicely. So i read this last night and my blood was boiling

Of course I wrote back and basically told her that our house shakes, its not just light footsteps, it feels like an earthquake 24-7. I cant even display our wedding china bc a peice almost broke from the walls shaking. I tried to explain that they also live in a condo and they have to realize its not a house and they have to have respect for their neighbors as well.. and that i never once asked them to stop their kids from playing or to change their way of life. I actually really tore them a new one in my note because I was so pissed off.

I just hate not feeling comfortable in my own house. I hate not being able to relax and just nap or watch tv.. and I hate having to fear running into them.. bc if i do i think i might lose my mind and flip out. Its such a horrible situation and its even caused fights between DH and I recently. I need out

Sorry for whining. I really really needed to vent.

Wow they obviously are being super spiteful… I hope you really did smash their pumpkins.

I really really really wanted to and still do but deep down inside i have a heart and cant ruin a two year olds pumpkin. Its their parents I dont like, not them and its not their fault bc their parents dont control them.

but i am very unstable right now so maybe i will

Me, I'd be spiteful right back. Play extremely loud music right up until 11 pm, or things like that. That's just how i am.

sorry to say - Id be the same way too... does that make me a bad person?? When DH & I lived in an apt - it was on 1st flr - we didnt have little kids - but a college couple & a friend & they constantly had loud parties til 4 or 5 in the morning - I had landlorad speak to them - but it only improved to where they only went until 2 or 3 am instead of 4 or 5 am - so what we did was start blasting music every morning - right when we knew they'd be going (or trying to go) to sleep - they soon got the message & moved out

Im so sorry you are dealing with this! We live on the second floor and we always tell our downstairs neighbor to please let us know if we are too noisy. We have hardwood floors with a couple area rugs but know that if the lower neighbor complians we have to put in full carpetting. I would definitely read and re read those bi laws! Im so sorry!

I wish we had nice neighbors like you! and I wish we could force them to get carpet.. but I was told by the board that they can not force them. They offered them free carpeting and offered to tear it up and sand and stain their floors for free when they were trying to sell it and they wouldnt go for it.

Yup I was on the 11th floor in a co-op and it was a high rise building. Same rules!

You had to have 80% of your floors covered with thick noise reducing padding and carpet.

The guy above me did not follow these rules and even had a TREADMILL in his apartment. When I tell you it sounded like someone was about to come thru my ceiling!!!!!!! I wrote a letter to the management company complaining that I was paying maintenance and that he was ruining my quality of life and CC'ed my attorney, sent it certified mail.... I got a letter a few days later as the cc'ee that was sent to him from the management company that he was in violation of the house rules and that they'd be inspecting his apartment in 30 days...and to DISCONTINUE use of the treadmill.

I can't believe that there are no rules in your building about this,...

I wish. I am pretty sure a Condo is different than a Coop.. coops have alot more rules. This what I found online about the board.. there is alot more stuff about how basically in a condo you own it so the board can not interfere like they can with a coop..

Powers of the board: Despite the fact that many condo associations contend that they are empowered to either approve or disapprove the transfer of ownership, the reality is that they have almost no power at all. Co-ops, on the other hand have the right to approve or deny the sale of shares on the basis, for example, of the buyer's perceived inability to make the payments. They can also block the sale to celebrities; for example, who they feel may disturb the peace and quiet of other shareholders. Cooperatives, of course, are bound by federal fair housing laws and cannot discriminate against buyers due to race, religion, sex, nationality, etc., but they can -- and do -- choose people based on financial resources and criminal background. Condos cannot exercise that kind of control.

I am writing a note to the owner again and sending him a copy of the letter they left on our door. I read online that in condo's if you can prove that it is unbearable and that its beyond the noise of just daily living then they can impose fines. I am going to push that they take this action.

Jen coops def have different rules but that doesn't automatically mean that your condo assoc cant help. Right now I think its that they don't want to be bothered. I know you probably dont have the time with work and school to sit and read the rules but I would bet there are a few things in there that are on your side. If you can find time to read them and then write a letter tot he board with the sections quoted I think it will get them to react.

Thanks hun! I have read them so many times but I plan to do it again this weekend.. I def. had to miss something because I dont remember ever seeing a section on noise and I know that can not be possible. Someone down the block got a fine for playing his drums too loud too late so I assume there has to be guidlines. If I cant find it I will request new rules. The owner of the complex really likes John and I and he stops by to see how we are and to apologize for the noise and has done alot to try and help us so I am just going to keep pushing the issue with him.

Re: Annoyed!! a long vent

I have nothing much to offer on the matter, but just wanted to say im sooo sorry to hear you;re going through this!!!! The few times our landlords have been extra noisy, I absolutely couldnt take it... A 14 yr old's bday party in her room that is above our bedroom on a week night that last until at 11:30... It sounded like the teens were going to come crashing down on our bed!!! I was sooooooooooooo pissed... I cant imagine having noise like that every day/night

Hope the issue gets resolved soon for both you and DH's sanity! Hearing things like this makes me damn happy that we are buying a townhouse condo instead... Come move where we'll be living What condo are you in?

Bayvillage in Patchogue.. all the way at the end of ocean. It is a great place, we just 'got lucky' and got the ONE couple with kids above us! go figure. They have goregous townhouses too that I wish we had bought, but at the time 2 years ago when we bought the condo we couldnt afford it.

Re: Annoyed!! a long vent

when you go through the rules....dont just look for noise. Look for any requirement for floor covering....anything that you can use to argue your side.

Are the condo rules in a book or do you have an electronic copy???? If you have an electronic copy email them to me and I will find you a dozen things you can use....LOL

Re: Annoyed!! a long vent

I'm sorry to hear you have to go through such a rough time with your neighbors. I have the same problem myself so I completely understand what you are going through. I have one upstairs that stomps literally day and night. Not sure if they have kids but I know it's a couple that lives above us and it's a nightmare. She walks back and forth and moves furniture in the MIDDLE OF THE NIGHT at 4AM!!! I woke up at 5:00am in the morning to her stomps and banging. I used the same technique writing her letter. No response. I'm seriously either reporting it to landlord and 311 at this point b/c it's ridiculous. And to top it off, that's not the worse part, we live right across a college student that cranks up the music at night and smokes pot. I have to shut all windows when the smell seeps through, that stuff is so strong you can literally smell it through the hallway. Or better yet just get DH to handle it in person since he is an NYPD officer. (Just to scare them a little). I think that's the best you can really do unless you want to press the issue and go through civil court. Unfortunately, noise complaints are not really handled by the police department. It goes through civil court.

It really is a great, beautiful place... minus the a-hole neighbors. I was actually having dinner last night with two other ladies that live there and one of them told me that apparnetly my upstairs neighbor has been talking sh*t about me for a year now to everyone, yet she has always acted nice to me until this week... so now im even more mad... but apparently she comes across as completely psycho to everyone so they took it all with a grain of salt.
