tax question?

tax question?

sorry, i'm sure this has been asked before but I thought since we weren't married the full year we can still file single if we want to.

DH is running our taxes as married filing separately and married filing jointly and either way we end up paying. I keep telling him I think this is still our last year we can file totally separately but he is ignoring me. Does anyone know?

I've NEVER not gotten money back, and now because we are filing together it is screwing us over.

thanks........

hi. my understanding is that if you were married as of december 31, 2008, you are considered married the entire year and have to file as married. whether you file as married filing separately or married filing jointly is up to you but i don't think you can say 'single'. i could be wrong...i'm not 100% sure.

i do taxes for a cpa. this is the case if you are married as of 12/31/08 you are married.

eta: my college tax professor always told us to stay single so we didn't have the marriage tax penalty. getting married you pay higher taxes.
