Is this money that was deducted from your paycheck ? If your boss keeps it, then it is theft.
Did the company do any matching ?

Write a formal letter to your former boss stating that if he does not turn over your account you will be forced to take legal action.
Send it via registered mail, with a return receipt.

It might just be a small amount, but you work hard for you money and in these tough economic times, every penny counts.

you don't know any lawyers? I think that if someone just calls up as your 'legal representation' he'd move his a$$. Don't give up on this one. If you have to be a PITA and e-mail him everyday DO IT. Tell him you'll take him on a court tv show, call 7 on your side, do something...anything! He'll sign the papers instead of being hassled by going to court or being on shame on you, haha.

That sounds like solid advice Gina- I would do that! Let us know if you don't get a response. It just seems criminal to me.

You have documentation that he agreed to roll it in your current account?

I would contact the broker the x-employer uses or the company for the retirement directly. You should be getting stmts from them.

I agree that you should bug the crap out of him about it! Keep calling/faxing/e-mailing!!! He has to sign this for you- it's your money. Even if you just threaten to seek legal counsel, it might scare him into just signing it. Good luck!!! Cheer up!

I agree with the other ladies...definitely keep on him about this. Every day!!!
Can you get at least get a letter from a lawyer? Also check online, I don't think he is allowed to do this legally!! It's your money and he has no right to do this or withhold your money.
Please keep us posted about what happens and good luck!!!!

agreed - send this letter certified mail return receipt requested as your first step. if that doesnt work, u need to find a lawyer to help you - just try to find a friend-of-a-friend to do it for nothing or almost nothing.
