Is this money that was deducted from your paycheck ? If your boss keeps it, then it is theft. Did the company do any matching ?
Write a formal letter to your former boss stating that if he does not turn over your account you will be forced to take legal action. Send it via registered mail, with a return receipt.
It might just be a small amount, but you work hard for you money and in these tough economic times, every penny counts.
That sounds like solid advice Gina- I would do that! Let us know if you don't get a response. It just seems criminal to me.
You have documentation that he agreed to roll it in your current account?
Ya I'll do this. He also did respond to my email requesting him to do it, and I have him saying to fax it and confirming he got it. But since then he has ignored my reminders.
What a jerk! I swear I would keep emailing and faxing him every hour on the hour!!

I agree, scare him with legal action and hopefully that will help. This is not right at all and something has to be done. Good luck

i contacted the 401k company I used for my old job because I have been emailing and faxing my old boss since may or june to sign off on the paperwork for my 401k because I have a new one with my current job and want to roll over the money. And he wont do it. He responded to one of my emails like 2 months ago saying he would do it and I have since contacted him and he wont respond. I would call him but I used to work there and I know I'll be put in voice mail and he doesn't check his voicemail. Thats why I email and fax cus I know he at least is seeing it. So anyway I called teh 401k company to see if I could roll it over through them and they said I can't because he has to be the one to sign off on it. I explained how he hasn't and probably won't, and they said there is nothing they can do. And I asked if he never does it does that mean I never get my money? And they said yes. Its not like make it or break it amount of money, but its still my money. And I want it.
Does your company have an HR department? If so, can you contact them?

I could call the other owner but he won't have a clue what Im talking about- hence why the other owner is in charge of these things. It was a pretty small company and he never liked doing things involving past employees. He is weird.
I would absolutely call owner #2 as well. Whether he understands it or not, he won't be happy to hear that his partner is exposing the company to liability like this. It might lead to a statement like 'I don't care what else you do, just sign the da#n thing before she sues me too.'

It sounds like you would be wasting your time / breath with a phone call. I would GO THERE and speak directly to him. It is easy to avoid a call or just delete a phone message, but when you are there in his face, he would be more inclined to just sign the paper to avoid repeat vists. And if he should ignore you, i would start going there every single day and calling every 1/2 hr on the hr till he made time for me.
