Accident.. need help any cops??? ** UPDATE **

my mom was stopped at a red light and a crazy luny guy rear ended her.. now this guy is insured but the vehicle he used is not.. and my mom's jeep needs some serious repair.. she called 911 but the dispatcher said it will be a while and to wait and take the information down.. so she did and then he took his stuff and said he wanted to get stuff.. this is about 30 minutes into it.. and he drove off.. my mom and her coworker waited another 10 mins and drove to the closest precinct and they gave her a form to fill out and send to albany... ?!?! i never heard this before and they can't file a report without both parties being there... doesn't this constitute as leaving the scene of an accident??? not sure what to do now??

*******
As of 6/27

my mom is not hurt per say, it was a dodge van and she was in a jeep, so the impact was to the corner and below.. she did have a headache after it all though..
so the insurance issue.. geico told her that they would have to investigate as to who the car is registered to and who the insurance company is.. she doesn't want to go to court.. no time and whatever.. but she's going to turn it to Geico to go after him.. i feel so bad for her.. she was going to a end of school year party..

Ok, I don't have any professional knowledge, but if she has his insurance information, can't she file a claim with her insurance company and provide that information?

I was thinking the same thing...then again....if he drove off....how do we know his 'info' was his?

Edited to add.....Was there damage to his car? Does she have a description of it?

i dont have professional knowledge either but i agree. If she has his information then thats all she needs. If he left the scene then that just makes it worse for him not your mom. They can still file a claim since she has all his info. Many times after an accident you can take down the persons information and then you just call the insurance company and file a claim and they handle the rest

Re: Accident.. need help any cops???

but this guy's car is not insured, only he is..

my coworker told me that she just has to file it and it's not technically considered leaving the scene b/c he cooperated in giving his information... my mom and his guy both have geico and geico said the vehicle he used is not insured so i'm not sure what's the protocol with that.. she's talking to geico now..

doesnt insurance cover you if lets say somebody did leave the scene and didnt leave their info.

you said he is insured just not that car right...well was that car somebody elses and he has another car he has insured...You did say he has insurance so they will go through that.

He drove off? Did you get a license # on the car? You have a name on him? FH is a Suffolk County Cop!

my mom got all his information.. name, address, lic plate.. i think reg. number also.. not sure.. i kept asking her questions and she got annoyed at me.. she's on the phone with geico now.. i hope that they will go through him rather throw us the crap that the car was not insured...

Re: Accident.. need help any cops???

Isn't it illegal to drive a car without the car having insurance? Your mother should speak with someone else at the precinct. Ask for a supervisor... the guy should have been ticketed. What happens in a hit and run accident.. of course police can fill out an accident report w/out both parties.. jesh.. what are police for???? somethings not right.

If the guy has insurance (under another car??) he is still responsible for any damages he causes... I'm suspicious if the info he had was legit. Anyhow, your mom's insurance should take care of the repairs and also try to get reimbursed by the guy's insurance.. if they both have geico then it shouldn't be an issue. Your mother should sue the guy in small claims for her deductible out of pocket expenses since he caused the accident... but again.. it would be helpful to have a police report.. but at least she has a witness. take photos of the car!

It should not make a difference whether the car was insured or the guy was.
I don't quite understand this part - was the guy driving someone else's car ?
If the guy has car insurance of his own, then he is covered when he drives another vehicle.
I am not on DH's insurance for his car because I have my own insurance for my car. If I have an accident with DH's car, I am covered under my plan.

Good luck to your mom, and thankfully she was not hurt.

i didn't quite get the part of how he can be driving without the car being insured either.. but i'm grateful that she's ok.. i'll hear back from her a bit later.. i don't live at home now.. so i'm panicking more than her..

thank you everyone..

Im a claims manager at an auto insurance company. It doesn't matter if HE personally has insurance on his OWN car.. the insurance follows the car not the driver. If you are sure the car is NOT insured...then you may have to sue him.

Does your mom have his info?

Yes she has to fill out the paper work and send it ti albany. That is the accident report. Technically it is leaving the scene of the accident if she did not get his info. But if he gave her the info it's not.

exactly. You don't need the cops present. as long as you get the info thats all tha tmatters. if he refused to give the info and just left then thats is a hit and run.

I *think* that even if the car he's driving isn't insured but he is insured, his insurance will cover the accident if deemed his fault. I believe there is a mandatory coverage on all insurance policies that insures you driving someone else's car.

ok I am a cop in brooklyn.... so first of all was anyone injured? if they were he can get arrested... knowingly driving a car without insurance is a MISD. so he can get arrested does your mom have any info on him

Re: Accident.. need help any cops???

I work as an adjuster. the form the precinct gave her is probably an MV-104. Because a cop did not respond and file an official police report, this is the form your mom can present to her insurance company to document an accident actually occurred. did your mom get the tag#?
what exact info did she get?
it doesnt matter if the guy himself is insured, it matters if the vehicle itself is insured.
FM me for more info.

I am sorry that this happened. I don't really have much insurance knowledge but I had gotten hit while my new car was parked in the parking lot and the driver left the scene. I went through my insurance and it was covered less my dedcutible.

I must admit though, everyday I hope that what goes around comes around!
