Any lawyers???

I have a ??. How long does it tkae normally for a malpractice law suit to start and to finish? Can you change lawyers in the middle? And do you have to pay the first lawyer if you win?

Re: Any lawyers???

Im a soon to be lawyer (graduating from law school in May) You can send me FM if you want and I can try to help you out. It's hard to say how long it takes for a malpractice action to start. In my experience I have found that unless there is a settlement the court process usually drags on and can take up to a couple of years. As far as changing lawyers, you can fire your lawyer whenever you want, but the lawyer can't just quit in the middle of representing you unless they get approval by the court (i'm assuming you want to fire your lawyer in this case.) As far as payment, I don't do malpractice law, but as far as I know the attorneys are paid on a contingency fee basis and don't get paid unless they win the case, and their fee is 1/3 of the total verdict. I hope this helps, let me know if you have any more questions!
