my best friend was hanging out with this guy and she made it clear she only wanted to be friends and he wanted more ( a relationship) well she kept saying no and he said he was going to call her job and tell them all this stuff...well we go onto craigslist to find that he's posted 2 things about her. It states her full name and where she works saying shes a drug addict and how can 'you people' ( meaning parents of the kids) have a person like that working here ect-i printed these things out. The thing is, shes going to school to become a teacher and if lets say a school district were to look her up and find this..well she would not be getting a job. Shes extrememly upset-this guy wont leave her alone and now hes getting in the way of her job and carreer. Would she be able to file a lawsuit against him for slander? What should she do????? PLEASE HELP!

Re: any lawyers on here??? need help
not a lawyer but in law school... It is absolutely slander (as long as everything he says is 100% not true and she can prove it) and it also sounds like its becoming border line stalking/harassment. Go to the police with the print outs and get in touch with craig's list to get them taken down. Also if there are any phone calls/ text messages keep those and bring those to the police as well. You cannot sue him unless she has proof that what he posted has negatively affected her work/social life.
Its a horrible situation, i hope it works out.

Re: any lawyers on here??? need help
Has he done anything else in terms of harassment, like contacting her by phone or anything... If I knew every little thing he's done to bother her I could be of more help, either a restraining order could be filed against him or criminal charges of stalking or harassment can be brought, depending more upon his conduct. She should contact craigslist and demand that they remove the 'slanderous and damaging material that a 3rd party posted about her for the sole purpose of harassment immediately'. You can FM me more of the details if there are any if you'd like.

Re: any lawyers on here??? need help
u def could call the police and also get an order of protection against him. ur friend should really do this now and get it started. the only thing with oreder of protections is she will need to know where he lives cuz someone needs to serve him she can't do it herself

I am a lawyer and I basically agree with knbs...fyi if/to the extent any of the things he posted are true even if they negatively impact her career/reputation she cannot sue for libel (libel is written, slander is verbal). But if the statements are outrageous enough she may be able to sue for intentional infliction of emotional distress but it might be a stretch because court generally don't love IIED suits-I would see a tort attorney if she thinks she wants to pursue any of the above actions...as knbs notes aside from suing in tort, your friend may want to contact the police to protect herself from this person as he is obviously disturbed. The texts, posts, and any other written information evidencing this guys harassment would help with a libel suit (if it comes to that-I hope for your friends sake that it doesn't) and also should convince the police to take some action.

Also he could have posted stuff about her on other websites. There are services on the internet that search for negative info about people and remove it. That might be something your friend might want to look into too. If your friend does that she may be able to sue the guy for the cost of removing the negative information.

Re: any lawyers on here??? need help
You can contact Craigslist and have them remove that immediatly. They have a contact us link on the website. They can't give you any info about who posted it, but they will remove it. The next thing you should do is report him to the police for harrassment and that he is a threat to your friend. You can obtain an restraining order. And hire a lawyer. She needs to keep this creep away from her and should use all the resources she can to do so.
