Any lawyers out there?

Any lawyers out there?

What should I do if I am extremely unhappy with the performance of one of my vendors and would like my money back? What is the process for taking them to court? Do I need to hire a lawyer or can I take care of it myself?

Any input would be appreciated!

What kind of vendor/what are you unhappy with?

My photographer was missing for large chunks of time:
30 minutes while we were getting ready
first 45 minutes of cocktail hour
over 2 hours during the reception.
This is confirmed by the time stamps on the photos we do have.
We have no idea where he was but he missed a ton of key photos
What do you think we should do?

omg that's awful - does your contract say anything about satisfaction? either way it doesn't sound like he met an industry standard and you could probably take him to court on that, for small claims you don't need a lawyer. depends on how much you'd want to sue him for.

It will depend on the amount you want to sue him for. Under a certain amount is small claims, you can go to the local court and ask them for the paperwork. If its small claims there is no need for an atty. You will most likely not be able to get a full refund as he did perform to a certain extent. Have you spoken to him about a partial refund?

Thanks guys...

I spoke to the owner and he apologized and said he was willing to work with us and give us parent albums and additional prints for free. However, now he is being difficult and saying we can only have 30 5x7 photos in our parent albums and essentially saying that he won't give us anything worth over $1000 total. And he is acting like he is doing us a favor by giving us anything at all!
I do not see this acceptable given how much we paid for our package and the poor service we received. I would prefer not to go to court but it looks like it may come to that.

Make sure anything he promises you from this point forward you get in writing - very specifically! You might want to mention to him that you're considering filing suit, people tend to be more accommodating when they hear that... especially when they know they are clearly in the wrong.

also do you own your photos as of today? He may not do anything further for you if you file suit. Im not trying to say dont sue but just be prepared for him to be even more difficult once you do sue.

If you still have items in your contract left...albums, video, prints I would guess that he would stop doing those items pending the outcome of the suit.

This is what I'm afraid of
Now I'm waiting for him to put whatever it is he deems appropriate to give us in writing.
