DH is so upset...

I am doing a depo tommorow. The chances are slim, but maybe I will be on the case.

Tell your DH not to be sad. Depositions are no big deal. I don't even talk about settlement until after the deposition when I am representing an insurance company. I want to see how credible the plaintiff is, how the plaintiff appears, etc. Plus there is a lot of information that you an get about a person through a deposition. If there are permanent injuries I want to hear the person tell me what pain they still experiencing and how that has effected their life.

Are you going with him?

Yes I am going with him....he's not nervous about tomorrow....
he's more sad that it's not over yet, it's a very difficult point in his life that he'd like to put away, ya know? It's got to do with an ex-gf, the accd't, him losing a career he loved.....

Cases are won or lost in depositions. Most insurance companies won't settle a major case without a deposition. That's where you do all your fact-finding and get the answers that the parties are generally stuck with. It's better off that they do the deposition and get it over with. That will either give them the impetus to settle or not. Try not to worry about it. 3 years, unfortunately, is not a long time in civil litigation.

it is a car accident lawsuit in which DH was hit by an 18 wheeler in his Ford Focus 3 YEARS AGO!

This was before we were together, so I only know what he's told me/shown me

omg.......those ford focus cars are LIGHT...
my mom got hit by a cadilac who went through a red light and it totaled her car,spun her car around....

I was in an accident in February of 1993, got sued in 1999 (yes they waited 6 years), had depositions in late 1999, and settled in May of 2000 the day before the trial was supposed to start. They always settle, but it does seem like they want to do depositions first.
