Dilemma

Dilemma

Hey,

I’m writing this post with a lot of pain in my heart and tears in my eyes. My fiancé and his ex have split for three years in which they both have moved or so we thought. The reason for the break up is, she wanted to be with a friend of his who is married, and now that she has ruin her relationship and he is not willing to leave his wife for her, she decided to take it out on my fiancé. Prior to us moving in together, they both has settle on an agreed amount that he should be paying for both his son and daughter. One of the stipulations I the agreement was for his son's school fee to be split in half. My fiancé didn't want to hide anything so he told her we were moving in together, that's when she decided that she will not pay her half because he is in her term 'Big Balling now.' Upon learning through his mother (who doesn't like me because I refuse to talk negative about her son) she decided to take him to court for child support. With his mother supporting this and insisting that she goes through with the support, she did and the judge awarded way more than my fiancé can pay. Both judges didn't even take in consideration that she makes way more than him. When all the money is deducted from his check, he only brings home $294 every two weeks. This is putting a strain on us because we have rent, con ed, other bills and a wedding (hopefully) to pay for. Then to make matters worst, she doesn't allow my fiancé to see his two children unless it's on her terms, and it's usually when she has to go out or do something. She told him in email that if he wants to see his children he has to come to her home and see them which makes no sense because we have an apartment. We have visited to lawyers in regards to this matter and they told us our case is hopeless not even reviewing out documents in full. One just told knocked us down you would think he was then judge. The ironic thing is both lawyers told us they would take the case, but they doubt anything will change. We decided against it because we can’t waste money that we don't have and when we both are struggling. We honestly don't know what else to do because at a time when we are supposed to be happy, we're being knocked down. I would appreciate any advice or suggestion on how to handle this matter from anyone.

Thanks in advance.

Re: Dilemma

hugs for you!!! unfortunately i don't know any of the laws so i am not aware about stuff like that. I am sorry you are dealing with this right now and it sounds to me that she is just soo jealous that your FH found someone else (you) and she can't handle it!. I am sorry that your FH is dealing with this because in reality they would always give the preference to the woman and make the man pay more in some cases its sad but true. All I can tell you is that things will fall in place sooner or later and you guys will be happy. No matter if your wedding is expensive or on a budget your wedding will be beautiful no matter what.!!! and the love you have for each other will surpass any obstacle. I would recommend to keep staying by FH's side and let him know you are there for him and that you are both gonna make it in the end!! Good Luck and feel better hun

Wow thats a tough one. Its a sticky situation anytime ex's and children are involved.

To me it sounds like there is no reason why your FH should not have proper visitations. If he pays her and those are his children, he is entitled to see them. I would definitely pursue this with a lawyer to get a set time, like every other weekend and one day per weekday. But find the right lawyer first. You need to find someone who believes in your case so they are willing to fight for you.

I'm soo sorry that you are dealing with this , it definitely sounds like she is very jealous of you and your FH and the life that you two are trying to build together. I agree with the other girls that you should search for other lawyers that believe in your case and are willing to help you fight, your FH should have more visitation and not based on what she sets up

Re: Dilemma

Thanks to everyone who has responded to the post and offer advice and suggestions. I really needed this because I felt like we were both going crazy because we were clueless as to what to do. The funny thing I did left out was the fact that after the judge awarded her the amount she wanted and more, her exact words were, 'Good, now let's see how they have their wedding.

State guidlines are that the parent show doesnt have custody should pay 25% of his salary if there are two children involved. Usually, in addition to the 25%, other expenses like medical fees, daycare, activities etc are split 50/50. Is that what the court mandated? Also, your FH should have a visitation agreement drawn up. It forces his ex to adhere by it. It typically includes weekend visitations...every other weekend he would get them...as well as division of holidays.

My FH has two kids which he has custody of...so I know the guidelines pretty well. Unfortunately we get ZERO money from her

If oush to the limit she will carry on in front of them. I wonder that too if we are that important, and the funny thing I pray is God bless her with a good man, one that will marry her so she could leave us alone. I hope she finds one soon.

Re: Dilemma

As far as daycare, it's split in half, but she told the judge to have them place on his medical because she doesn't want to pay anything. The judge told him he should because if not then it will be more money out his pocket. Also when he told the judge he wasn't seeing his children alot, the judge told him be thankful that you even see them.

Where in the world is this judge from???? I went through a rough divorce. It started in 10/05 and was finalized in 1/08..... long long time .... my ex does not want to even spend time with his son( which stinks so bad!!!!) and my son who is 8 now is realizing little by little what his dad is all about .... FM me so we can talk ... I have been through this for a few years now ....and since both of our lawyers did not finish up our divorce ... I DID IT MYSELF !!!!!!!! You have to fight for your rights...but you have to do it the right way !!!!!!!!
