For those of you who are pregnant and need to work full time - do you know anything about going on disability afterwards for a month or two? I have been told that post-partum is not considered a disability and you would not be entitled to any disability pay - but my husband says he called NY State and he was told that that is not the case, that you can get disability pay for 2 weeks prior and 4-6 weeks after the birth - has anyone looked into this? Thanks!

Re: Does anyone know about pregnancy and disability?
Could you tell me how you went about getting it? Do you persue it yourself, or did you just tell your employer you needed off and they looked into it? ARe there forms to fill out - do you have to do them in advance? Is it a certain amount related to your salary, or just a set amount? Any info you could give me is much appreciated!! Thanks!!

I got the forms from my job. You fill out part A. Your employer fills out part B, and your OBGYN fills out part C. HTH
It goes by your salary. I believe it is like half of what you normally make

Re: Does anyone know about pregnancy and disability?
If your dr puts you on on leave for a medical issue, that would be considered disability. Normally, only the 6 wks for reg. delivery (8 wks for csection) is considered 'disability' by the state, and the remainder of your time off would probably fall under Family Medical Leave (FMLA).
So in many cases, it's half and half. I'll be out on disability for 6 wks and then taking the other 6 wks of FMLA time, which can or cannot be paid, depending on your company.

You can only receive 1/2 of your normal salary up to $295 (I think it is) a week.

That's it? Wow, they told me it wasn't much, but that's ridiculous!! I was hoping it was at least 1/2, which is double that!!

I think it differs by company and what your company will pay into it. I could be totally wrong, but I know that my maternity leave will be considered disability and I get 12 weeks off-PAID.

kptoys - You're referring to disability, right?
FMLA depends on the Company - some don't pay at all, some do, it's not required.
And that's right about disability starting 5 days after the birth, or injury, etc. So in my case, I have to take 5 days sick pay (our Co. policy), then 5 weeks disability, and then the remaining 6 weeks unpaid FMLA leave.

Re: Does anyone know about pregnancy and disability?
I think you ladies are confusing STATE disability pay with a corporation's private employee disability benefit policy.
The state will only pay a certain amount, based upon your salary. But, many companies (at least the larger ones) have separate disability insurance coverage for their employees. With the payment from that insurance, plus the state payment, you usually end up closer to your full-time salary. At least that is what happened for me in CA.
Also - my FMLA benefits were not including the 6 week 'standard' maternity leave benefit....I had 6 weeks given, 2 weeks vacation/personal/sick time AND THEN my 12 week FMLA kicked in....so, check w/your HR dept, b/c alot of companies structure their maternity benefits differently.

Re: Does anyone know about pregnancy and disability?
Claud that's an excellent deal! The norm is usually 12 wks total from what I hear.
Yep, my company supplements the state disability so that's how I will be paid for those 5 weeks (not incl. the 1 extra wk of sick time I'll get).

Re: Does anyone know about pregnancy and disability?
Claud- CA has a MUCH better maternity policy than NY State has. Here you get a total of 12 weeks of job protection (with FMLA). Your employeer must have over 50 full-time employees to be required to enforce FMLA. This includes the 6-8 weeks of disability. Some companies require you to use all vacation/sick time before going unpaid, even though in total you only get the 12 weeks off.
My company (even though we are small) had private disability insurance and I was paid 80% of my salary minus the tiny amount the state paid for 6 weeks, then for an additional 2 weeks I got state-only checks because i had a c/s. i also got both checks for 2 weeks prior due to my GD and complications i was having.

Re: Does anyone know about pregnancy and disability?
I dont think my disability was from the state... I dont really remember. I know that my employer paid a certain company, not the state, quarterly (i took care of the books). Also, it took 2 weeks to receive a check after she was born, yes it was for 2 weeks but it still sucked. I also got it for 8 weeks since I had a c-section.

Re: Does anyone know about pregnancy and disability?
Oh my God, I am due in November and I have almost used up all of my sick days. I won't have 5 by the time the baby comes. What do I do then? I still get the six weeks right, probably just that first week is unpaid I guess.

Re: Does anyone know about pregnancy and disability?
You should check with your HR department or office manager. The FMLA statute says that if there are 50 employees at your job, you are entitled to 12 weeks leave, but your employer is not obligated to pay you, only to allow you 12 weeks leave and ensure that your job will be there after 12 weeks. Some companies pay for FMLA leave or allow you to use your paid leave consecutively, rather than concurrently.
Also, if your company offers short-term disability, you need to see what that policy entails. My short-term disability doesn't kick in unless I am unable to work for three or six months first. I keep wondering why they even offer such policies becuase how would I survive the first couple of months without pay???
I envy you all that NY State pays anything at all. Maryland does not. And my firm only offers six weeks of maternity leave. We'll see if I can get that changed once I get pregnant

Re: Does anyone know about pregnancy and disability?
You need SHORT term disability. Long term kicks in after 90 days of short term disability.
For those women who are TTC you might want to take a look into buying private short term disability insurance. you can cancel it after you have the baby, but you cannot buy while pregnant.
