For those of you who are marrying cops or know cops...

Are they allowed to make you get out of the car when pulled over and pat you down??? This recently happened to a friend of ours. If a cop tells you to get out of your car, can you lock your windows and doors and refuse to get out??? Sorry about the off topic question

FH is a cop. I don't think so unless they have reason to believe you are high. I'll ask FH later when I talk to him.

no you cannot, it falls under search and seizure laws, if they have any suspicion they can uphold for a search, you can get slammed just for refusing to cooperate.....trust me i wouldve trapped myself in the ride plenty of times if it weren't the case!

I believe they must have just cause. Like if they see something in the car, or if they believe you are drunk, high, etc. I would guess if you're 'mouthy' they will do it too.

ETA: If you refuse to get out once they've asked you I'm pretty sure you can get slapped with obstruction of justice or resisting arrest, insubordination...something like that.

Thats what I thought. Someone else told me that once you get out to lock your doors that way they dont have the rights to search your car without a warrant. Only thing with that is, FH has had his car searched and when he talked back they only got more aggressive with him, throwing his hat on the floor and stepping on it and then threatening to punch him in his face. But then again he was pulled over by undercover detectives...

actually, if it is a normal traffic stop and you have done nothing wrong, you can lock your doors and call 911

you can do that, but if they suspect you have something they do have the right to search your car, even after you call 911. you can call to 911 to verify that the person who pulled you over is a cop. Doesn't get you out of the search.

i think they need a cause...but you can call 911 and they can make sure that it is a real cop that pulled you over...

yes but they have to have a reasonable cause to search you
a normal traffic stop wouldnt 'warrant' a search and pat down

in most cases you dont need a warrant to search a car, a cop needs probable cause, or the person has to consent to the search. Closing the windows and locking the doors is not the best thing to do.

a normal traffic stop can easily turn into a search, if they suspect something when they approach the car.

If someone gets pulled over for going through a stop sign and the officer has reason to believe something else is going on, it can turn into a search.

hmmm
i was actually told to do this by a deputy inspector IF an officer is unnecessarily rude or demanding

understood but the question was not about a warrant
the OP asked about getting out of the vehicle
