TM doesn't mean it's a registered trademark yet, they probably filed a tm application, once it's on the official federal registry, it appears as the r in the circle. But if put tm next to it, it's a sign to others that they are using it as a trademark and are pursuing a registration (usually), to protect their rights in the meantime.
