Yeah, now would be the time to lay it all out there. What can they do? Fire you?

Good luck! You are worthy of better things!

Re: I am definetly getting fired

I was told by a previous employer when I resigned to go to a new job that if there was a gap between my employment I could apply for unemployment and they wouldn't disagree with it. Every company has a different policy, some will tell the state not to pay, others don't want to take the time to deal with it. You could always apply and worst case you get denied.

doesnt the company have to pay for some of the cost for any unemployment benefits that the employee may recieve?

Re: I am definetly getting fired

Well I am here at this godforsaken place right now. They dont have the slightest clue that I saw the post on hot jobs for my job, and that they are planning to FIRE ME....I am actually writing my lovely letter of reseignation now, will a fill in the date blank, and going to carry it around with me. If I get called to HR to be fired, I am quitting first. I want to make it at least till Friday.

I hate corporate america.

ETS: I originally wrote letter of recommendation, but what I meant was resignation

you should bring the post on hotjobs to HR

they can't fire you without a written warning

What do you mean they can get in trouble? For posting my job without telling me I'm being let go?

ETS: I looked it up again on hot jobs and its been altered, looks like the font was changed and now its dated 5/10/2005, today, as opposed to yesterday (which is when I found it) whats up with that?

Yes they do. Typically if you are fired for perfromance reasons the company will not dispute unemployment. If it is for Insubordination, gross misconduct, etc... they will dispute it.

Yes they can - unless she has a contract. It is called being an employee at will. Either party can terminate it's relationship at anytime without notice. Obviously as long as it is not based on a discriminatory practice.

Re: I am definetly getting fired

So wait, I can quit at any time and they can fire me at any time...correct? I thought that I could only get unemployment if I was laid off? If I am fired for performance issues (I hate that, I am so not incompetent, read the original post if you want, it'll explain this whole ridiculous story.) can I collect unemployment? I'm confused now

What should I do? Should I wait here to be fired with the possibility to collect unemployment b/c of performance issues, or quit so that I dont have to say I was ever fired???

You can actually apply for unemployment when you quit too. You can say that you felt pressured into resigning because you were afraid of being fired and give your reasoning why ( like your job being posted on a job board and your boss setting you up, etc....). Unemployment makes a ruling on whether or not your are eligible. The company will also provide reasoning, like your write up and other examples trying to dispute it. Or they may not, it really depends on how bad they want you out. They may feel they got off easy since you resigned and let you collect unemployment. It is really hit or miss.

I don't understand why you don't just print up the job listing and confront them about it if you're prepared to either be fired or resign anyway. Perhaps you'll actually find out the truth- either (1) that they are planning to terminate you (and then you'll know your future), or (2) they are creating a new job b/c of additional workload and you're not getting fired. I'd just march in with the listing and demand to know the deal.

I agree. They may offer you some incentive to resign. Try to negotiate yourself a deal. If they want to get rid of you badly they might give you some severance.

if you are feeling pressured to quit, pretty sure that is constructive discharge and therefore you are entitled to it.
