I CAN'T WIN!!

I CAN'T WIN!!

Hey girls. I'm writing to vent b/c no one is around and I don't know who else to talk to. I don't know if you all remember, but in August I was in a bad car accident (not my fault - thank goodness) and I have been out of work ever since. (I fractured my back in the accident) Soooo, to make a long story short, not only did the company I work for call me today and told me they no longer have my position - they filled it with someone else. And that when I'm medically cleared I can come back to work in a different position (making 20 thousand less) and if I don't take a position they'll fire me AND I went to try on my dress and after 10 minutes I had to take it off b/c it hurt my back so much (it's too heavy). So not only is my wedding dress too heavy to wear but I don't have my job anymore and as we all know, weddings are so expensive. I'm stressing sooo much girls. I had to buy a new car b/c of the accident so that's just another bill. FH is trying so hard to be so sweet and caring. Thank god for him!!! Thanks for listening.... now I have to find a job!! Help....

I can't believe your job did that, thats horrible. Isnt there some law against that or something.

i thought by law, you're suppose to get your job back if you're out for a medical reason

I am so sorry to hear that, on both counts.

if I were you, I would call a lawyer and see what kind of case you have against your company. how crappy of them!

Aww I'm so sorry. With enough exercise I am sure you can strengthen your back to be able to carry the weight of the dress... In regards to the job issue, that is absolutely terrible... What field are you in?

Look into that and fight it I don't think your job can do something like that. How long have you been with them? I'm so sorry

I'm so sorry that happened. That sounds illegal to me though - I would definately look into it. Hopefully your back will start to get better, at least you have another six months to help strengthen it. What bad luck you're having

I'm so sorry for whats going on. Theres nobody over your boss that you can speak to. That stinks. Don't stress about the dress just yet. Your wedding isn't for another 6 months and I know you'll feel better by then to wear it.

FM me if you need an attorney - the guy I'll refer you too helped me with my Unemployment case after I quit my job with what was in my opinion (and the judges) good cause.

That's just crazy, but you can't put anything past employers they'll hang you out to dry as long as they're making their money - no one cares anymore about anyone else!

Everyone is right, I believe that is against the law...I am so sorry for everything that is happening to you. All I can offer is

Actually, they have a right to replace you if you are on disability for more than 3 months. I found out about this when I was on disability. Legally they can replace you, and there isn't much you can do about it, it's their right. As much as that s ucks, it happens to be the law. They need to keep things moving, and losing an employee for 3 months is a long time for work to be made up.

However, telling you they will fire you if you don't take the lower position for less pay, you might have a case with.

Re: I CAN'T WIN!!

there is a law about that I think after one year they can fill your position but know its to soon I would look into that!!! I hope all goes well with the dress you have a couple of months so hopefully your back will heal more by then

The FMLA (Family and Medical Leave Act) law only provides job protection for up to 12 weeks per calendar year. It sounds like she's been out since August...so whether this was morally right or wrong ...legally they are able to do this. You can trust me on this one...I've been in Human Resources for over 10 years....I deal with FMLA every single day.

So sorry about this happening. I'm sure things will look up in 2006.

I'm so sorry. Something doesnt seem right here. Do you have a union? Id go right to the president. I know in some cases they can put you in a different position, however cutting your salary that much after you have been through so much just does not seem right! Id FIGHT FIGHT FIGHT!

That's a F**** way to start the new year. Maybe you should take advantage of the time off to look for another job

I'm sorry your job is adding insult to injury. I would call the Department of Labor. They have trained people available to answer your questions FOR FREE. They can explain the Family & Medical Leave Act, some disability rights laws that affect employment, and general labor laws regarding how long your position must be kept open, and whether or not a job must be available to you upon your return and at what salary.

Good luck!!

Hey girls. I want to thank all of you for the encouragement. You're all so sweet. Well, as someone said, the FMLA (Family Medical Leave Act) only protects my job for 12 weeks and then after that - I'm S.O.L. Soooo, now I'm kinda just stuck. I'm trying to find the optimism in all of this. By the way, Happy New Year!! Maybe 2006 WILL BE a better year for me. Thank you all again....

i would look into the legal aspect as far as your employment goes. Sounds a little fishy to me.Some employers set you up at home. Maybe thats something to look into. Just an idea. I'm sorry to hear about your dress. I don't have a solution for that. Good Luck
