So last night as i'm going to bed, my tenants (who have a basement apartment in my house - it helps pay the mortgage) come banging on my door. Apparently the pipes in my kitchen burst and it flooded their ENTIRE apartment and no one knew cuz they weren't home and I was pretty much asleep. It took us all night to clean the water up. I took off work today and I have a guy coming to repair the damage to the house. My tenants who are an off and on again couple with a baby have a million people in and out of the apartment including the mother. The mother was flipping a sh*t on me like I did this all on purpose. She threw out everything down there (couches, rugs, entertainment system, etc) in the apartment and a lot was fine! One of the couches was hardly wet and the entertainment system stand would have been fine once it dried. I had my dad and FH check it out. She just wants my money and wants me to replace EVERYTHING. Shes not even my tenant, her son is. So who knows whats gonna happen. I'm so stressed right now.

you are NOT obligated to pay for any of their stuff, just to replace the pipes, and replace your rug and such. But anything that was damaged like their OWN personal belongings should be reported to THEIR renter's insurance carrier... Dont get suckered in by them or their mother. Thats what renters insurance is for... sorry to crash, I've had this happen - and I also work in the insurance field, and have dealt with this quite often.

I have somewhat of an update. The guy came and took down all the insulation from the ceilings in the basement and he's gonna be repairing everything else this afternoon. The job isnt gonna be too expensive which is good and my parents said it's not even worth it to go thru my homeowner's insurance. Not exactly sure why but we'll see. I have 30 days to claim it anyway.
With the tenants, I found out 4 of them have been living down there and there's only suppossed to be 2! I told them we'll talk about reimbursement especially since they should have told us about the other people living there. It's a 2 bedroom, not a 4. And if I was renting it to 4 people, I should be getting more money. My father is getting involved now cuz he's pissed so we'll see what happens.
so wait you only have 2 ppl on the lease and they have been lying to you this whole time and keeping it from you? that is illegal and what they are doing is completely wrong. This happened to my parents many years ago, but this ppl went to the extreme. It was also a basement apt and it was also just for 2 ppl, OMG next thing we knew there were at least 10ppl living down there it just happened out of nowhere too. They told them to get out bc not only were they crazy for having so many ppl living down there and lying to us about it but then they started having late night parties and going nuts. My parents went to evict them and they said they didnt have to move, it turned into a mess but my parents had to take legal action bc what they were doing was wrong.
So especially with this truth coming out, if they were smart they would keep their mouths shut since they are not following what the lease says.

ok that mother is a psycho! im really sorry to hear bout this but seriously i would take lots of pcitures of the stuff that she threw out so if they try to get money from you you can take her to court and show that there was no damage done and they wont be ableto get anythign out of you...take lots of pics especially at the bottom of all the furniture! good luck and sorry again

How did you not notice 2 extra people coming in and out? You live there, right?
I know all my past landlords watched the place like a hawk - and would have definitely known if extra people were coming and going all the time.
Anyway, if it is a legal apartment, you don't have to pay. However, if it is an illegal apartment, you could report it to insurance and try and reimburse them. However, since they clearly broke the terms of the lease, you have no reason to be nice.
Have you talked to your tenants directly or are you still dealing with his insane mother?

well if it was like the mother and somebody else then i am sure when she saw them there all the time she didnt think much of it since well its the mother and you just think ok she comes to see her kid alot. Not only that but if these ppl are lying then i am sure they were sneaky about it and made sure they didnt realize. Like they probably know the times they leave in the morning and wouldnt leave until after that. At if she saw the mother going in at night, i doubt she was sitting there waiting to see what time she would leave. They couldve even pretended they were leaving at night and then come back later on or who knows.
It does sound weird, but i remember when this happened with my parents. Yes we did realize it not long after but at first we didnt know. They were VERy sneaky. They wouldnt leave the house in the morning until they knew we were all gone. Plus they had people all the time coming there to visit them so not like everybody is gonna keep track and say ok well 3 ppl went in so lets see when these 3 will leave. And the funny thing is that alot of times they would leave, we would see them at night leaving the house, but later on they would come back. So they made sure to play the act.

well to answer all the questions lol, i did see the mother and the cousin (who were the extra 2 people) going in and out of the house a few times but i figured they were visiting. after awhile though i confronted my tenant about it and he said they were just visiting and what not. so i let it go but was still suspicious of it. when we were down there the other night there were air mattresses in the 2nd bedroom that they dont really use so that's how i found out they were living there. i told them they have to be out by next month at the latest. the other 2 can stay for now just as long as there arent problems about replacing anything they said were damaged. its been quiet for now. i already replaced the ceiling and the pipes were repaired yesterday. so the problem is taken care of and i dont want anymore issues from them.

and yes i do live there but my entrance to my house is on one side and their entrance is around the side of the driveway and thru the back. so i hardly do see them coming and going. the only time i see them or hear them is when im in the driveway, getting in or out of my car

You must be a nice Landlord. When I had visitors at my last place, she basically told me she expected me to escort them from the driveway to the house (to enter we had to go through her backyard). My sis had visited once so the next time she came she didn't bother calling from the front of the house. My landlady basically stopped her in the backyard and asked her who she was and what she was doing there. And then yelled at me for not 'escorting' her from the driveway.
We moved about 2 months later. My landlady was like 'I'm so sorry to see you go - you were such nice tenants' - yeah, then why did she watch us like a hawk.
