I need a Lawyers opinion

so i was in a really bad accident last thanksgiving. my car was rear ended on the LIE by a kid in a truck. We were going about 40 mph, he hit me doing 60. the force of him hitting me pushed my car into the HOV lane where I was hit AGAIN by a minivan full of people.
My car was totalled (rear window blown out, trunk crushed, side airbags out, and axles broken. but I walked out with not a scratch on me. the kid who hit me was ok as well, but one of the 6 passangers in the minivan had to be taken to the hospital. I didnt go through insurance and settled w his insurance for a settlement to which I got a new car. (mine was paid in full and I got the reimbursement for a new one)

I just got in the mail a summons that I am a defendant in the case against the car full of asian immegrants (yes they do not reside in this country) and they are suing me. The summons states that I need to make a personal apperiance or written notice to plaintiff's attorney within 20 days.

My issue is that THEY HIT ME!!! and they were not wearing seatbells, which is why the woman when flying from the bench seat in the middle to hit her head on the dash board of the front of the car.

I dont have an attorney and do not want to go through my insurance as I dropped them after the accident and when i got my new car 3 months later i got a new insurance company. Can I still go through my old company even though I am not a client?

I spoke w my friend who is a divorce lawyer about basic legal issues. I just want them to drop me as a defendant as I DIDNT Cause the accident, and THEY HIT ME!!!!

Hi. I'm a Paralegal and this is kinda tricky.

Pretty much was happening is that they are counter suing you. Which is fine don't worry, no $$$ is going to be coming out of your pocket. Now since you did switch insurance companies your going to have to call both insurance companies and let them settle the case. Your insurance company should provide you with an free atty that will handle your case.

Unfortunetly, my atty only handles plaintiff's cases.

I work in insurance and you need to contact your insurance company. Your insurance company needs to take care of it. They probably sent that letter to all parties in the accident. Your insurance company will act in your behalf.
