I NEED SOME SERIOUS ADVICE- Update pg. 2

I can not go to much into details as I do not want the vendor to find out who I am. I am obviously using a false name.

Heres the deal. I was recently married. What would you do in this situation?? I was supposed to have something with one of my wedding vendors. It was in my contract to have it and it was not there. My DH had to go and get it on their way to the ceremony. He had to pay for it himself too, the person there from the company did not even offer to pay. Now, I feel that is a breech of contract. It was clearly stated in the contract that we were to have that. We signed on it and expected it. What would you do?? I want to pursue it considering we payed a substantial amount of money for their service and did not get what was agreed upon. I plan to write a letter asking to be reimbursed for the money DH had to pay out. Does that seem fair?? And if they do not agree to reimburse, do you think I have grounds to sue in small claims court to get the full amount we payed for the service back since there was a breech of contract?? I am torn with what to do, but now that I have had the time to think about it, I am mad, because they forgot to give us what we signed on, I was 45 minutes late to my own wedding. What would you do?? Do I have grounds to get any money back? Do you think I should pursue it?? Thanks!!

Um. OF COURSE you should pursue it. What are you torn about? I'd try calling or writing them to ask for the money. Chedck your contract make sure it's there and if they don't respond, DEFINITELY go to small claims court. Where's the dilemma here?

Thanks!! So my next question is, would you go for it all back or just the money that we had to lay out for the missing things??

you have fm

it depends on how important what was missing is. If it was something that gave you alot of stress or was REALLY important then go for it all or as much as you can get back.

if not you should AT THE VERY LEAST get back what you laid out.

If it is stated in your contract that he agreed to provide this service, you paid for such service, but never received it, then I'd say you absolutley have every right to ask for a refund. Why pay for something you didn't get???

Have you approached the vendor with this situation yet?

If he gives you a hard time, I'd go to small claims court. If for no other reason than principle.

If this happened to me, I think I would want to tell the world about this vendor. You should want to make public what they did or did not do, and one way you can retaliate is by spreading the word. I don't know why you would want to 'hide' this from a vendor finding it--why do you care if they know you are upset? They would certainly find out in court. Likewise, it is hard to judge the worth of whatever it is they left out without making mention of it.

I would write a letter and asked to be reimbused for the item. Small Claims court is a different story. You will probably not be able to get back the full amount of the Vendors cost - since he fulfilled the majority of his services. The court my require him to reimburse you for the item and filing costs.

I would ask for everything. You can always settle on less but I would ask since technically they did break the contract. If you dont succeed this way, I would definately go to small claims court, the fee to file is small and in my opinion worth it.

I would ask an attorney about the breach of contract thing. But you can defintiely get the $$ back. I mean you did't get inot enough detial so I don't know what it was or what %of the ful service it was. If I went to small claims court I might sue for the $$ that was paid out, and maybe some additional $$ for the inconvenience. I don't know what you can get for breach of contract. You'd really have to consult with an attorney. but one way or the other, you're going to get back the $$ you paid out. I'd call the compnay to see how they respond to your complaint, the I'd call a lawyer.

You may want to contact the BBB also. check to see if this vendor has had any previous complaints with them.

45 minutes late to your OWN wedding due to the incompetence of a vendor? by all means write a letter and flat out tell them if it is not resolved to your satisifcation you are going to contact a lawyer.

if it was in fact clearly stated in the contract, signed and dated by both parties, then YES it is a breach of contract.

ETA: you are entitled to the out of pocket money spent (services agreed upon and not rendered), but not the full reiumbursement. i would wait on outting the vendor unitl the situation is resolved (don't let anyone pressure you or make you feel bad about not disclosing the vendor).

Re: I NEED SOME SERIOUS ADVICE

here is a question - is the cost of the item or service that they didnt provide worth hiring a lawyer?

You probably wont be able to get the full price of your contract back since they performed it - but you probably can get back the cost of the missing item/service.

I think small claims court might be the easiest -

Before you go to that though - try writting them a letter - ASAP and notifying them of their failure to perform - and specify where it says it in the contract.

Re: I NEED SOME SERIOUS ADVICE

I would discuss this with the vendor . . . Is this something you signed for? If you signed off that you received something without actually seeing it, you may run into a problem -JMO. Before I would bring this vendor down and spread their name all over the place, I would CALL the vendor and talk to them. If you call and discuss and still you have no success, then I would maybe step things up a bit. I just don't think you should jump the gun without starting with the vendor. Why try to destroy someone when it could be that they will make compensation for what was left out. Give the vendor a chance to make right by you before jumping the gun. I wouldn't really write a letter. I would make the call. I think it also depends on how important this missing thing was and how expensive . . . I wish I knew more details so that I could give you better advice. Good Luck

I think most people already know not to use this vendor. The reason I am not posting my name or theirs is that I have not approached them yet about this matter, I just wanted to get some advice first. I will post it as soon as I have cleared up this matter. But there has been plenty of posts about this vendor and NOT using them!!

Re: I NEED SOME SERIOUS ADVICE

Thank you all, wish me luck. I am not a mean person and I am a bit nervous about calling. I really have to psyche myself up for this!!

This all came to bug me lateley as I was watching my wedding video and I saw the clock. I was supposed to be married at 3 pm and the clock on the wall in church said 3:45. I think that is what brought this all back to me. Some guests that came to the church to see me get married actually had to leave before I even got their because it took so long and the whole timeframe of the day was thrown off. We were so behind schedule from the escapade with this company that people were showing up at the hall already while I was standing there taking pictures, which wasn't supposed to happen. It just made my whole day very rushed because of these peoples mistake. If you want to know who they are, you can FM me your e-mail and I will send it to you, but I will not post it on here until it is resolved,.. I don't want to give them anything to come after me for slander. Thanks for understanding!!

Re: I NEED SOME SERIOUS ADVICE

HELLO! You paid for it in the contract and then paid AGAIN to have it the day OF your wedding???? Breach of contract and yes, pursue it!!!

Re: I NEED SOME SERIOUS ADVICE

MegLehner is right... although you DO have a claim, you probably won't win the full price of the contract because the vendor performed part of the contract. But, before you even pursue small claims court there are a few other, easier things you can do (I've had a lot of experience in this). First, find a friend who is an attorney. Have them send a letter kindly asking for reimbursement for part of the contract was not performed, and slightly threatening suit if the vendor refuses. If that doesn't work, try email. A few months ago I was ripped off by AAA. I called them and tried to work it out over the phone, to no avail. Later, my FI and I drafted an email to AAA, cc'ing as many AAA high executives we could find on the internet, AND cc'ing the better business bureau, federal trade commission, complaints.com and the local news station that requests stories on fraud. The next day I got a call from AAA offering a full reimbursement. Try it!
