I NEED SOME SERIOUS ADVICE- Update pg. 2

Original post by Whatwouldyoudo?

I can not go to much into details as I do not want the vendor to find out who I am. I am obviously using a false name.

Heres the deal. I was recently married. What would you do in this situation?? I was supposed to have something with one of my wedding vendors. It was in my contract to have it and it was not there. My DH had to go and get it on their way to the ceremony. He had to pay for it himself too, the person there from the company did not even offer to pay. Now, I feel that is a breech of contract. It was clearly stated in the contract that we were to have that. We signed on it and expected it. What would you do?? I want to pursue it considering we payed a substantial amount of money for their service and did not get what was agreed upon. I plan to write a letter asking to be reimbursed for the money DH had to pay out. Does that seem fair?? And if they do not agree to reimburse, do you think I have grounds to sue in small claims court to get the full amount we payed for the service back since there was a breech of contract?? I am torn with what to do, but now that I have had the time to think about it, I am mad, because they forgot to give us what we signed on, I was 45 minutes late to my own wedding. What would you do?? Do I have grounds to get any money back? Do you think I should pursue it?? Thanks!!

Did you pay by credit card? If the letter does not work and they refuse to credit you the money you were out - put the amount in dispute.
I assume you have no other payments due. Hmm - I would always ask nicely first. YOu never know what can happen and what they will do to save their reputation or just to do the right thing. If you put it on a credit card - you have a lot of leverage. If not - you can always file a complaint. BBB probably won't be a huge help but you can always file a complaint and then go to small claims court.
Sorry you had to go through that on your wedding day

Yes definitely pursue it. Make a copy of the contract and put that with the letter. Mail the letter CERTIFIED so you know it was signed for so they can't say they didn't get the letter if they don't act on it.

Be couteous in the letter but be honest and have your facts.

If they do not reply in a month write again. Tell them you'll report them to the BBB. Certified mail again (everything certified and photocopied - you want a paper trail).

If still no reply, and it's worth it, take them to small claims court. You may also want to (if you feel necessary) call the Attorney General's office - he handles things like this, I think.

Good luck, sorry that didn't work out for you

definately ask for something back
if they forgot something then ask for the price of what it cost to buy that thing...

also if it was a limo being late i think that is grounds for getting at least part of that money back....we had that happen with a prom limo the company was almost an hour late and we almost took our own cars to the place, they only charged us half the amount then...

Re: I NEED SOME SERIOUS ADVICE

Well, I am going to retrieve the contract now and I am going to call them. Wish me luck!! I am nervous. I am not good at these sort of things. I think I might call my lawyer first to get some advice and see if there is anything I should say. I will update later and let you know how it goes!! Thanks for all your advice.

Well, things didn't go as I planned with the company. They seem to think I am stupid. I am being forced to pursue this in court. Please, if you want to know who they are FM me your e-mail address, because I don't want anyone to go through what I am now going through!!

Those of you who FM'd me and i didn't answer, please don't think I am being rude by not answering you, but I can not post the company in FM as LI Weddings does not permit the bashing of vendors on this site. If you give me your e-mail I will send it to you but I can not send it in a FM. Thank you for understanding!!

I just want to say I am sorry you went through this!

In addition to the great advice you got from others on the board, I just want to say write down everything that happened on the phone today.
