if you are a social worker please read!! **UPDATE**

if you are a social worker please read!! **UPDATE**

so i'm an LMSW & just started a new job (about a month ago) and absolutely LOVE it! the main reason i took the job is b/c its working with the population i LOVE... the other reason was b/c i would be getting supervised by an LCSW which we need 3 years of in order to sit for the LCSW test.

so i just found out today that apparently NY state office of professions made a list of agencies that are the only agencies that are allowed to provide LCSW supervision hours - if you dont work for one of these agencies - then your LCSW supervision hours are INVALID!!!

i havent seen the list yet so i'm not 100% sure that my agency isnt on it - but with my luck its not & i'll be fuucked

i'm so upset right now

**UPDATE**

so my friend is getting me the list today, but she forwarded me an email that was sent by her co-worker who told her about this whole new law.... bascally, its FAQ's about the new yok state regulations for LMSW wanting to obtain their LCSWs - if you FM me your email address, i can forward you the whole thing... but here is the most important part that talks about what we were talking about last night:

Q. According to the most recent interpretation by the State Board, what are approved facilities for logging hours toward the LCSW license?

A. According to the most recent interpretation set forth by NYSOP, any LMSW or LCSW working in a facility that is NOT regulated by OMH, OASIS, OMRDD, OCFS, or a 'local social service district' and provisioned to provide 'clinical social work' services may not receive credited hours towards the LCSW. These settings are not approved by the OP and therefore, supervised hours accrued in these non-licensed settings may not be acceptable toward the LCSW. Providing clinical social work services independently, as a private practitioner, independent contractor or per diem worker (if paid via 1099) are considered operation outside of the scope of practice for an LMSW and is therefore, prohibited.

Q. The NYSOP says it is the social worker's responsibility to find out if the setting is appropriate from their employer. What happens when the employer doesn't know the letter of the law and tells the LMSW or LCSW that the setting is legal?

A. Then it is actually the LMSW/LCSW who is ultimately held responsible for the legality of the facility and is completely unprotected from professional consequences (including invalidation of experience by NYSOP).

Q. What might be legal settings to work in as an LMSW but that still won't count
toward LCSW?

A. Any facility in which the LMSW is NOT conducting a minimum of 20 hours a week of 45 minute psychotherapy sessions (i.e. a school, housing facility, medical hospital, etc), but in which the LMSW is employed and supervised, should be legal, however, the hours will not count towards the LCSW. An LMSW employed (W2 employee) by a non-licensed entity, psychiatrist, LCSW or PhD and supervised by a psychiatrist, LCSW or PhD could practice legally but would not be able to use the supervision hours toward the CSW license.

Q. Is per diem work acceptable? Independent contractor? Consultant?

A. If you are paid as a 1099, you are considered self-employed and therefore, independent; this, according to the OP’s verbal and written communication, is considered outside the LMSW scope of practice. Apparently, according to the recent interpretation of the law:

- if you are paid as a 1099 (self-employed), your hours will not count
toward the LCSW and you would be operating illegally.
- if you are paid via W2 – as an employee – for a licensed facility (OMH, OASIS, OMRDD, OCFS, or a 'local social service district' provisioned to provide 'clinical social work' services), you are operating legally and you can use your supervised hours toward the LCSW.
- if you are paid via W2 – as an employee – for a non-licensed facility, your hours may not count toward the LCSW

thats all for now... i'll update more when i have the list!!

I noticed that a lot of social work/ nurse positions are becoming joint positions...so weird it was never like this. I work with a ton of nurses and what i feel is mostly a nurses job but they are now hiring SW to do the same things...a way to pay less and have the same job done. Getting really frustrating.

I work for a managed care company that is an LMSW position....I have been procrastinating on taking the exam but I must take it by November. I have to be honest I'm not thrilled with the field anymore so I am exploring my options. I may just apply for a limited permit until I figure out what I want to do

The nurses that now do the same EXACT job as I do get paid more than I do and I'm just so aggravated with it. Now, if they had additional responsibilites that required additional skills or whatever then fine, they earned it, but thats not the case.

And you're right-- it was never like this.

You know I can't put a finger on it. I have honestly worked in every setting so it's not just my current job I just feel bored. I find myself not caring as much and that REALLY bothers me. It just stinks so much money and school wasted plus I happen to have a really decent paying job for the field so it's tricky plus i'm in the union
