because someone was still living there, would you take $$ off the rent you pay?
The girl isnt moving out until tomorrow, so we cant move in until the 4th, Should we take three days off rent??

It depends, is this a complex or part of someone's house?

If you already signed the lease and it states that you have the apartment from the first , then I would and I would make sure you did an inspection before moving any of your stuff in or they might hold you reliable if there are any damages and cleaning.

I am the renter. We signed no lease. The apt is in a house.
I was at the apt less than a month ago, and it looked like no one ever lived there to begin with, the place is immaculate.
Im wondering if we should take off $100 or so for the days we were unable to move in.

Absolutely. Or arrange to pay on the 4th of every month. You should never pay for something you haven't gotten! I'm sure the landlord is charging the other girl for the extra days she's in there.

Definitely! Divide your rent by 30 and then multiply that number by the number of days you'll be short getting in - that's what you should deduct from the rent.
(EG: if your rent is $900/month, you would deduct $90 from your first month's rent)
I'm surprised the landlord didn't say this to you already

If you didnt sign a lease then I dont think there is much that can be done, I would just tell her that youll pay on the 4th of every month since you are not actually moving in until that day. Dont let her scam you!.

just pay the rent on the 4th each month instead of the 1st.

Hmmm, I think paying on the 4th might come back to bite you in the a$$. Anywhere you go from this apartment will likely require a 1st of the month move in so you'll still wind up paying these extra 3 days at some point.
I don't think they'll have a problem with it, I really don't.

i am a little confused. as the renter, it is not your decision to deduct money. ask the landlord if they can pro-rate the rent for you for the month. ie. 1600 a month / 31 = 51.61 * 3 = 154.84 deduction.

Re: If you couldnt move in on the 1st of the month..
I am a landlord and we had someone move in 3 days earlier because it was easier for them.. However, we never charged them for the 3 extra days they lived there. I thought that was just too petty..
However, being the renter, I might ask to take money off...

I think it is your decision because you are not able to move in on the day that was decided. I would definitely talk to the landlord about pro-rating your rent. More than likely they won't bring it up if you don't...
