I was laid off from my old job upon arriving home from my honeymoon on April 9th. I was an office manager there and whenever someone was let go or fired in the middle of a month, they had their insurance till the end of that month. And then we would send tehm COBRA if they wanted to extend it and pay for it themselves. I got my cobra last night in the mail and they canceled my insurance while I was in Brazil and still thought I had a job!!! I am so fuming mad about this! What if something happened? For the past week and a half I thought I was still insured till the last day of April. Can they do that? They didn't even lay me off yet and canceled it first. Im so pis*ed! They are so slimy. Im glad to be out of that place!

WOW that is crazy and yeah from what i know you have your insurance until the end of that month. They also always send the cobra letter. I don't know how obligated they are according to the law but definitely find out, maybe they are obligated to

idk if its legal, every job should have a written termination policy, check with human resources, then an insurance agent, and maybe a lawyer.....???

My last day was like march 24th. But I was still an employee. I had not been laid off. I was not told about being laid off till April 9th in the evening.
My last paycheck was the last day of march. I asked my old boss to send me a paystub.i want to see if he took out aprils insurance fees. because if he did, then I want that money back!!!

I was human resources. The policy was that they carried out through the rest of the month. Because tehy already would have taken the money out of the employees paycheck and paid for them. We got paid teh 15th and the last day of the month. The money got taken out the last day of the month for the next month. Even if they ahd already decided to lay me off, they didn't tell me! I even left the nmber of where we were incase of an emergency. And I was out of the country. What if something happened and i thought I ahd insurance and then didn't? Thats just wrong!

Im going to takl to my dad about it- maybe he will know. Its just so annoying! And it makes me even more mad cus I hated working there. I'd work overtime and it said in my contract tehy would pay me for it and they never did- even when i said something. They treat their admin employess like crap. Im so glad to be out of there!

Re: Is this legal???????
they can legally cancel it effective your last day of employment.
god forbid something DID happen - you could have went on COBRA - it's retroactive.

If you worked at least one day in that month then you are legally entitled to insurance for that month. Often times employers pay for health insurance a month in advance.

No they can't do that. Contact an employment attorney

This is not the truth. Some employers terminate health coverage on midnight of the last day worked. It really depends on the employer. The cobra will cover you retroactively till the day coverage ended but it is not legal to cancel someone's health insurance until they are notified that they are no longer employed with the company.

Re: Is this legal???????
I worked in HR for many years too and know it is up to the company's discretion when they want to cancel your insurance.
They can cancel you mid-month but usually they have to pay the full month anyway....that is why most companies keep you on until the end.
Anyhow, I think the law says they have to send you the COBRA letter and you have 60 days to elect if you want to stay on. So even if something did happen in Brazil....you could have still picked up COBRA and had it covered.
It is BS tho that they did that to you while you were on your honeymoon....not cool at all.

Re: Is this legal???????
They laid you off while you were on your HM? That is really horrible of them!
I am not sure if you are covered for April, but you get COBRA and you have time to decide if you want it (so you can elect COBRA retroactively just in case).
But I cannot believe your company would wait until you went on a HM and THEN lay you off!
