Excuse me if this is a bit nosey...just wondering what you girls think.
I don't even know the particulars. Do you have to be worth a lot to get one??
We aren't getting one.

Re: Is/Did anyone getting a prenup?
We didn't get one, but my boss (an attorney) did recommend that we get one..And we are NOT worth a lot of $$. The reason he suggested that we get one was because we are buying my family's house for considerably less than Market value. So my attorney suggested that we get a pre nup for the equity in the house, so that if anything ever happened b/w us, FH would only be entitled to the mortgaged amount and not the rest of the equity in the house.
ETA: I DON'T see anything wrong with them. My family and I decided that we didn't want one.

I think if you don't have a lot of money, then really it isn't worth it.
Basically you get one when you have a lot of your own $ and assets prior to getting married- lots of property etc...

Re: Is/Did anyone getting a prenup?
Funny you asked this, I was going to post this today but d@mn work got in the way.
To answer, no, we're not signing one. We both know that what's his is mine and what's mine is mine.
Did I say that wrong?

Re: Is/Did anyone getting a prenup?
I thought about it since I have more assets than he does.. but decided against it.
I think it's a good idea though.

Re: Is/Did anyone getting a prenup?
Here's a question for you attorney's out there...
let's say, (knock on wood) my parents passed away and were leaving me a great deal of $$ or real estate, whatever. Once FI and I are married, is that all also his? This isn't changing my mind about a prenup, I am just curious. It depends on my parents 'will' correct?

Re: Is/Did anyone getting a prenup?
Kim - if you keep the inheritance in you r na,e, and never comingle the infheritance assets, then he does not have a right to it.
If you go and buy a house with the mony you recieve form an inheritance, thenhe will get 1/2 of the house. You need ot keep it seperate if you want to get after a breakup. This does not apply to any other assets, just inheritances.

Re: Is/Did anyone getting a prenup?
Kim: Inheritance, personal injury suit awards and anything that was yours prior to the marriage is separate property and is not considered marital property (i.e. your spouse wouldn't be able to touch it). However, say you get $1000 inheritance from your parents and you put it into a joint bank account, it BECOMES marital property b/c the Court will assume that you also gifted it to your spouse. Also, if you put your husband's name on your accounts that were yours prior to the marriage, the same 'gift' theory will apply. Finally, as for real estate. Say you own a house on your own. Then you and your hubby live in that home as husband and wife....During that time living there as a married couple, the price of the house increased due to market forces ONLY..That house would still be considered separate property (as long as you didn't put his name on the deed). HOWEVER, if the house increased in value because your hubby fixed the house himself or stayed home and took care of the kids while you worked..The APPRECIATION of the house is marital property. Thus he would be entitled to a percentage of the appreciation of the value of the house from when you got married till the separation. Sorry this is so long..Hope it helps

Re: Is/Did anyone getting a prenup?
I was told I should get one, since I had some settlement money, but before we got engaged, he got an inheritance, so now we both have the same amount coming into the marriage.
But if you have a professional license that you got befoe marriage, it is always smart to get a prenup, so that future earnings based on that professional certification can not be gotten by th spouse as alimony.
I was advised since I am a CPA that I should get a prenup to avoid paying alimony, but we didn't, I don't like the idea, that you are a planning for a break up. IMO it makes an easy way out for some people, and there shouldn't be an easy way out.

Re: Is/Did anyone getting a prenup?
Hubby said he wanted one, I said what do you have to lose if we part We don't have any great riches to worry about.
I'm not totally against them...I think they are useful for people who have family businesses/assets, but like Michelle said...there shouldn't be an easy way out...IMHO I feel like the breakup is expected...
