Excuse me if this is a bit nosey...just wondering what you girls think.
I don't even know the particulars. Do you have to be worth a lot to get one??
We aren't getting one.

Re: Is/Did anyone getting a prenup?
We're not, although we probably should. However, FH wanted one for the wrong reasons and this was a fight we had long ago, so I'm not even going to bring it up again.
Re: Shelzy's post about professional licenses...if you have a professional license before entering the marriage, it is true that upon a split, your spouse may be entitled to the enhanced earning capacity afforded that license. Similarly, if a professional license is obtained during the marriage, and either joint monies are used to pay for it or if the other spouse supports the professional spouse in non-economic ways, they will be entitled not only to the enhanced earning capacity of the license, but also a portion of the value of the license itself...two different things. Just an FYI for anyone who may be considering earning a professional degree after marriage or who is marrying someone who is.

The only reason we would need one would be to protect each other from each of our debt.

No Theresa..inheritance doesn't become marital property unless you make it. Read my post on the last page to Kim.

Re: Is/Did anyone getting a prenup?
We are thinking about it - actually it was FH idea - he felt that it might make my parents more comfortable - since hopefully NOT for a very very very long time - were they to pass away - I would be getting a very large inheritance and although my family would LOVE to see my FH share in it - they would NOT like to see him get it if anything were to happen to us.
We look at it this way - although prenups are horrible and we dislike them - but as one of my profs said - NO ONE goes into their marriage with the intention of getting a divorce - and one can never know what might happen. FH is confident enough in our relationship that we won't ever need it - which I guess for backwards logic he therefore doesn't mind if we get one

Re: Is/Did anyone getting a prenup?
Just wanted to add my two cents on the inheritance issue. Yes, everything marcela and shel said is true and basically that is how the law is written, however don't bet on that is what happens when you are standing in front of a divorce judge.
From experience, my DH's grandmother died during his marriage with his ex and he got $$$ and he also received a personal injury settlement while he was married to his ex and during the divorce the judge gave his ex 60% of that money which was his! To this day he is very angry about this because he knows his grandmother would not have wanted his ex to have the money, it was meant for him. Also, he was shocked the judge gave her HIS settlement money he received due to HIS injury!!! She didn't have any pain or suffering.
Then as luck would have it the ink was not even dry on their divorce papers and her grandmother died and left her a house in Great Neck! She sold it and walked with $500K!!! He got nothing.
Gotta love it!
Most of us are not planning for divorce but be careful with the inheritance thing. If there is a substantial inheritance in your future, put it in your children's name!!
