Landlord legal issue

Landlord legal issue

Hi girls...well some of you know that we've moved into our new home. My previous landlord is giving me a problem about returning our whole security deposit. When I moved in there were iron burn marks in the carpet. I called the rental office and they told me 'no problem- we'll put it down in your file'. Fast forward 6 years when I move out...they tell me that they have no record of this and that they are going to charge me 600$ for these marks. I did not do it- I avoid ironing at all costs- I have a steamer! I lived in this complex for 6 years and I know they change the carpet in between long term tenants- as often as every two years. Why they didn't do this before I moved in, I don't know....
I just got off the phone with the landlord. He told me that it costs 1800 to replace the carpet but I'm lucky that he's only charging me 600. I responded- the carpet is at least 7 years old- you have to use the depreciation cost. He said that is the depreciation cost! I figured if he was going to charge me anything it would be a couple of hundred and I would chalk it up as a learning experience for not making sure that the damage was in writing. 600$ is a lot of money for us new homeowners and I'm not even responsible for this! I have pictures from when I moved in but they are not dated with a camera and therefore the landlord says it doens't matter.
Has anyone else been in this situation? Other than going to small claims court, do I have to just accept this?

Re: Landlord legal issue

it sounds like normal wear and tear to me...

I would take the landlord to small claims...

my old roommate did that to our landlord - b/c while he was showing the apartment, he decided to throw out garbage bags...but it wasn't garbage...it was her clothes!!! and she won...

but be prepared to be countersued...he then sued her (not me though) for $6K in damages!!!! (ETS he lost that too)

for next time...always take pictures of damages...mail them to yourself...and don't open them...they will have the postmark on it for proof of time...

A co-worker went through a somewhat similar experience. When they moved out the rental office agent told her she'd never seen a place left so clean and filled out the paperwork. They asked to come to the office to get a copy and were told they couldn't have it that day, it would be mailed to them. Fast forward a week or two - they get a notice that they are being docked for noxious pet odors and smell of urine and that the carpet has to be replaced. They never had any pets! I think they ended up taking it to court, I'm not sure what the outcome was, but it sounds like this is a scam to get you to pay for carpet replacement.
