NWR LL

NWR LL

This is long sorry. So we have a weird situation with our ll, we live with a very nice older lady and her daughter lives next door. In the begining we gave our rent to the ll upstairs and then about a year after we moved in her daughter told us to start giving her the checks because she is managing her mothers money so she doesn't spend it all. That was no big deal & we have been doing it that way for the past 3 years now.

We told our ll in august that we will be moving out soon and just waiting on our closing date. I see our ll upstairs all the time and chat with her, we have always loved her and she is coming to the wedding and everything. She had told me that we can go ahead and live out this month on our security. Well today her daughter calls me and says she has no record of us giving security & either does her mom. She tells me her mom is loosing it and says she doesn't remember ever telling us that we could live out this month with our security & that she needs a record of us paying it! So now she expects me to go to the bank and try to get some proof from like 4 years ago ! Im so pissed
I don't even remember whose account it came out of mine or FI's. She insinuated that maybe they liked us so much at the time that they didn't ask us to put any $ down and that is total bs. What would you do? Im worried that the bank won't have a record of it since it was a while ago and it was bought by Chase but I remember for a fact that we definitly paid it.

is it on your lease? If you remember the date you should be able to track down the bank withdrawal. In reality the ll should've put the security in a separate account but probably didn't. Did you give cash or check? My advice is to look up tenant rights in case the daughter starts to act silly.

This.

And if you gave a check, I'm sure you can still track it down.

Legally, a landlord has no obligation to allow someone to use their security deposit as the last month's rent. A landlord is supposed to return the security deposit after inspecting an apartment after the tenant has moved, and return it (less anything to compensate for damages that go above normal wear-and-tear). A landlord is also, technically, supposed to keep a security deposit in a separate account, but very few do.

If I were in your shoes, I would try and get proof of payment of the deposit. If they are saying that they never received it, then, in theory, it's your burden to prove it was paid. It is likely easier to check with the bank than to deal with a potential small claims action down the road (either them suing you for the last month's rent, or you suing them to get back your deposit). And also check your lease to see if it is indicated in there somewhere. Does your landlord give you receipts? If so, you might have one for it somewhere.

It really should be on the lease. If you paid it in a check, you should be able to track it down

even though your bank was taken over by Chase, you can still find out your recors from years ago. I have had to do this and have had no problems, especially with Chase. It just takes a few days to get.
Just ask them for all of your transactions within a certain period and they will get it to you.
If you don't know who's account it came out of, do this for both of your accounts

Thanks for the suggestions. Im just so upset by this because we have lived here a long time and it never felt like a ll tenant situation until now. My Fi would shovel the driveway for her she'd bake us stuff etc. We never had a lease it was month to month. I don't like it being insinuated that we would lie and say we paid it when we didn't, thats just ridiculous.

You must have some paperwork?

Nope none, we pay by check every month and we signed a background check paperwork when we first moved in but thats it.

Unless you can find something for the security deposit, you might be S O L

Get on the phone with your bank or you might be able to look it up online yourself. Does FH file the cashed checks??

He does not file anything! He is not the most organized person.I do all the banking at this point ,but we are in the middle of a move so everything is packed up and being that we had just moved in together at that point I have zero expectations that he has bank statements from then lol.
