I understand what you are going through, and I hope it all works out. I also hope the judge is easy on you, b/c you're representing yourself (which you may hear the judge refer to as 'pro se').

I'm not sure what court you are in, but as far as your evidence goes, there are certain rules in court about evidence being allowed in. If you are in small claims court, these rules are relaxed, but if you are in Supreme Court (the main trial court in NY) then you may be precluded from putting things into evidence. This is kinda where it helps to have a lawyer.

Good news is (and I hope this helps)-you cannot get an award over I believe 5K.

If you were just served today, tomorrow will likely not be a trial-you can represent yourself (pro se as Jess said)

Seriously, thank you everyone! I went to the court house a couple of weeks ago (actually, after I went to view CLM in Lindenhurst) to see the file. I read through and it filed an affidavit to clear my name. The judge signed it and wanted me to forward the copy of the affidavit to the plaintiff via cert. mail. Today, the PL sent me the papers of the original suit. It was very obvious it was my ex who did this (the check was under his name and was signed by him) but for some reason had my name on the case, which isn't right. He also open other stuff under my name without my knowledge and permission.

Another thing I noticed is that the PL kept saying 'he' and not 'she', meaning it's towards him. This is what is getting me upset because I didn't know anything about this. Plus he died earlier this year.

My mother just prayed for me to make sure things will go okay and hopes the judge can see that I never done anything wrong.

I just came back not long ago and here's the 411....

I told the attorney (representing the judge) about the situation and he told me it could be fraud and other stuff. So it looks like it was going to be wipped out but I did received the papers from the PL and then he asked the Assistant DA if she can look at it and she said no so he had to rip the statement he was going to present to the judge. So now I have to do is wait a couple of weeks in which I have to file one more time to have my day in court. I really do not want to go to trial for this but if this is the way to clear my name, then so be it.

At least I didn't have to pay anything today. But still my spirits is kinda down from this. I felt like I let my mother down and wouldn't be able to go through the closing this weekend for the house in PA.
