It's for his kids safety! How would he feel if G*D forbid something happened..he would have to live with it!

Nail the gate shut, then if the ball goes into your yard, they will have to come to your front door. This will also prevent the dog poop situation from happening again.

I don't think you're unreasonable at all. Considering the fact you have a pool, if one of the kids fell in I'm sure they would hold you and your husband responsible, right? As I see it, you're not only looking out for your property but their kids as well...which is more than one can say for him. I love it when parents set crappy examples for theirs kids. Then you wonder why some kids turn out the way they do. It's your yard, your property and they're trespassing. Period!

You are completely right.

My uncle was having work done on his pool and a kid from his neighborhood was being chased by the cops (!) and jumped the fence into my uncle's yard and landed in the pool on a spike!

THE KID AND HIS FAMILY SUED MY UNCLE!!!! Now, I am a paralegal in a med mal firm, but seriously? He was trespassing AND running from the police???

And I know my uncle's homeowner's insurance paid the family something, but really!

So, keep on making them stay out of your yard!!!

ETA- can you make them sign a disclaimer that if the kids/dogs do get injured there will be no lawsuit?
because that is the only way i can see a compromise

or just stick it in their mailbox

Even if the parents signed a waiver, I doubt it would hold up in court. However, I'd do everything to cover your a$$ including putting locks on the fence, hanging up a no trespass sign on the fence, documenting when the kids trespass and when you speak to the parents about it, putting correspondence to the parents in writing, and if it's necessary filing a report with the police. At least then you'll have proof about the constant trespassing. It $ucks when parents ignore their children's bad behavior. I hope the situation is resolved soon.

These people are out of their minds! It's not their property and you've repeatedly asked that they not help themselves to coming into your yard. That should be the end of the story!! They're trespassing! What nerve!

I understand this isn't illegal, but it is WEIRD. it's his own car!!! All four doors are now windowless and the back window looks frosted now!

what?? it is your yard! he cant give them permission to go to YOUR yard when you politely said no. you should go over there and talk to him. i think you have very valid reasons to have them stay out. pools and such can be dangerous!
