Opinions needed - landlords and renters

Opinions needed - landlords and renters

Last Wednesday with the heavy rain our apartment completely flooded. The landlord who lives upstairs helped us rip up the carpet, which was saturated and has said he will replace it all since he has said its his fault that the apt. flooded, because of some switch that he turned off. Since Wed, DH and I have spent hours cleaning up the apt, moving all our furniture back and forth. Our scale, answering machine, and garbage can all need to be replaced. We spent over $30 on airfreshners and cleaning stuff to mop up all the extra water. Additionally, I had to lose 1/2 day pay from work to clean up the apt. Plus, we have had the A/C on full blast all day everyday to get rid of the damp smell.

My question is - do you think I have a right to tell the landlord that I am going to deduct some money for Sept. rent for the hardship and money we have had to spend to get our apt. even somewhat liveable...Him or his crazy wife have not said even said they were sorry that this happened to us. I'm not blaming them, most of the houses on the block had water, but I think we should have some compensation for what we went through.

Do you think I'm right or should I just suck it up to bad luck???

do you have renters insurance or property insurance??? that would have covered the loss

I know when my old apt flooded and the ceiling actually collapsed from it - my landlord told me to submit any bills for and damages that were done. They saw that my coffee table was ruined and my couches/slip covers needed to be dry cleaned. (most of my other furniture was moved in timte - thank goodness!)

I didn't ask them to reimburse me to time lost from work or anything like that - personally I took it as things happen. And it did take a long time before the situations was dealt with and made better/liveable. But if things were ruined - they should reimburse you and if you had to buy special stuff to clean up they should reimburse you in my opinion and experience.

I would talk to the landlord about it. If the apartment is an illegal one, you can report him to the town... just be prepared to move out.

The landlord should pick up the bill of the damaged items, especially because he claimed responsibility. I would talk to him.

Thanks for the advice. I'm not asking to not pay rent at all, just to deduct the cost of the expenses. We didn't have renters insurance (which is really stupid I know!), but I was told that since it was an act of God, it wouldn't have covered it. All total, it wasn't that much maybe $200 or so, but the effort that has gone into making the apt. liveable has a been such a pain.
