A jury found Scott Peterson guilty of first-degree murder in the death of his wife, Laci, and of second-degree murder in the death of their unborn son today. The verdict reached by the six-man, six-woman jury leaves Peterson facing a possible sentence of death or life in prison without parole.

what sentence does that carry?
25 years to life with chance of parole for his wife.
15 years to life with chance of parole for his unborn son.
However, I have a feeling the defense attorneys might appeal which means they will go back to court with a new jury.
they will appeal, because that is what is always done. but i don't think they need to pool a new jury - only if there is a mistrial declared.
Once you appeal it becomes a whole new case with a whole new jury.

I think CNN made a mistake - they are showing life w/out parole or death penalty for Murder 1 and 15 w/parole for Murder 2...

i thought when you appeal, it went to a higher court, where a judge would decide if you have grounds for an appeal. ps - i'm not a lawer or law student, i just watch wayyyyy too much Law & order..

In order for an appeal to be granted they would have to find that something that occured in the trial did not uphold the rules of our judical system. It occasionally happens, but not too often. Almost all convicted felons appeal their verdict. I believe that you have only a certain # of appeals avalible to you.

10000% agree - i am soo aganist the death penalty. he needs to rot in a 6X8 foot cell for the 100 years.

The defense attorneys already are working on an appeal.. so far they are saying because the two ppl got kicked off the jury and those two ppl were the ones saying he wasnt guilty.
I have a feeling this isnt over.

I am not a lawyer or anything, but I believe that the appeal goes to an appellant court/judge who then hands down a verdict on the appeal. I know that a felon has more then one appeal, but I am not sure how many they have.
