I spoke to my photographer last night and was hounding him for my engagement shoot photos (I've been waiting over 4 months for them). I told him I need them within the next 3 weeks, because I'm planning on using the pictures to make a guestbook on mypublisher. He told me that I won't be able to do it, because professional photos are copywrighted and no one else has the rights to them, which means they can't reproduce them in any way. He siad if I want a photo guestbook he has to make it for me and I'm assuming that he's gonna charge me a pretty penny for it, when I could get it for under $30 online. Have any of u run into this as well? I see so many girls here making the photo guestbook using professional pictures...have u had any problems?

Re: Photos are copywrighted?
Yes the photos taken my a prof. are copywrighted. However there are photographers that sign a waiver that let u ge them printed elsewhere. Ur photographer should have told u that b4 u booked him.. and why is it taking so long to get ur e-pics?

As a photographer (landscape)...yes, all our work is technically protected...do people follow that rule all the time? No...but perhaps you can reach an agreement with him to make the book yourself and put his credits by the photos? Or leave business cards out on the table by it? just a thought

That's crap! Yes, they're copyrighted but I was able to take my to CVS and make copies. (Technically, CVS should've said no but they didn't even look at the pics or notice) At the very least, by a scanner and do the guestbook yourself! I wouldn't pay your photographer to do it...there are definitely way around it.

That's why I've been hounding him - I see most people posting their proofs the next day after a shoot and I've been waiting 4 months! I understand they're busy, but after all the money we're giving them I would expect them to get me my pics a lil sooner than 4 months....ugh

I thought about getting a scanner and doing it myself, but he's definitely gonna see it at the reception and then what do i say?

Re: Photos are copywrighted?
Yup it's true. The person who takes the picture is the owner of the image. You can buy a 'copy' of the image but you can't reproduce it with out the owners permission. I know it's crazy.
I spend a fortune at work buying images for our brochures/websites.

Re: Photos are copywrighted?
As a person who used to work in Staples copy center area, I can definitely say that I used to say no to customers that brought in professional pics because we legally were not allowed to copy them. However, I know that Kinko's has self serve color copiers that you can copy them yourself on, and they shouldn't really check what you are copying. I know I never looked at or payed attention to what people were doing at the self serve machines. That's an idea. The other idea would definitely be to get a scanner and do it yourself. If not you should ask him if he would sign a waiver giving you the rights to copy the photos how you wish. You would need to get a copy of that waiver though. I know with my prom pics I recieved a waiver in the mail and needed to show that in order to make any copies of it at a printing place. HTH!!

they are your proofs to do what you want with them. If you found someone to scan them for you, what could he say???
Send them to me, I have a scanner and I'm a graphic designer...I do it all for you! LOL

Re: Photos are copywrighted?
did you already sign him up for your wedding and sign a contract? If not, you can negotiate the right to all proofs as part of your pkg. That is what I did b/c I knew that in addition to my album, I'd want all the proofs to use for albums for my dad and inlaws. And I didn't want them to say 'proof' all over them or anything like that. I negotiated for all 600 proofs...... perhaps you can do the same?

What he can say is 'i am suing you for copyright infringment'...especially if you already discussed it with him & he said 'no'. Even though you have the prints, he retains the copyright of the actual images and you are not allowed to make reproductions of them without written permission.

I think this is a very good idea! And it might work out for you

Re: Photos are copywrighted?
Im sorry but Im not having this problem at all with who I booked. In fact he encourages me do all my prints and things of that nature. As for my engagement shoot I get all my pics on a CD that I can upload to shutterfly or something like that. I looked closely for this when shopping I was like why do they want to keep my pics and charge me all this money to do extra work. Like someone said I guess to stay in business. But I did not want any restrictions on my pics so I just got my rights upfront.

Re: Photos are copywrighted?
I wouldn't say ALL photographers practice this. I'm in the same boat as lisalisa27 When looking for a photographer I specifically looked for someone who would allow me to print whatever I wanted without being locked into their pricing structure and free to do what I wanted with the pictures.

Re: Photos are copywrighted?
It depends on what is in your contract. We have it stated in our contract that we get a full CD copy of all of the pics to be used for whatever we would like. We can make as many duplicates, photo books, montages, etc as we want.
