Poll: Was it inappropriate? Handcuffing and arresting a 97 yr old woman?
Just curious... personally I say yes.. Im sure they didnt toss her in the squad car and wretch her arm back or kick her ankles. The cops did they're duty. Besides.. she had expired plates, expired inspection AND an unpaid traffic ticket. What do you expect? JMO
What do you think?
Edited to fix the title to better match the poll
CNN Story:
HIGHLAND PARK, Texas (AP) -- Police say they had no choice but to go by the book when they handcuffed a 97-year-old woman and took her to jail for failing to pay a traffic ticket.
Harriette Kelton was arrested last week after officers stopped her for having an expired registration and inspection sticker and realized there was a warrant for her arrest for failing to pay a traffic ticket.
Kelton, a former schoolteacher who has lived in the Dallas suburb for decades, was in police custody for about two hours before her attorney arrived and she was released on her own recognizance.
'Our real beef with this is that no real judgment was displayed or actually carried out in this incident,' said Kelton's son Dr. Phil Kelton Jr., a plastic reconstructive surgeon with Baylor University Medical Center.
But police spokesman Detective Randy Millican said the officers had no choice but to arrest Kelton's mother.
'A warrant begins with the words 'You are hereby commanded to arrest,'' Millican said. 'How do you decide who do you arrest and who you don't? How about at age 90 but not at 91 and up? How about between 17 and 20?'
Phil Kelton Jr. said his mother lives alone, cooks her own meals, goes out to lunch regularly and is involved in the community. She has good eyesight, he said.
'All of our enthusiasm should be tempered with judgment, and therein lies my problem with this, and basically Mother's problem with it, too,' he said.
Her other son, David, is a state district judge. He said it would be inappropriate for him to discuss the arrest.

Re: Poll was it appropriate? Handcuffing and arresting a 90+ old woman?
We have a story down here in florida that is similiar to this but it involved handcuffing and arresting an 11 year girl for stealing $50 and a rabbit from the person next door...people are up in arms about it but the police said they could do nothing about it because the person next door wanted to press charges since the girl was taking things from them all the time. My personal opinion...if you break the law, you break the law and should be prepared for the consequences...regardless of age.
In other areas of life someone can not be discrimated on because of age, sex, race ect...the same should apply here.

I'm more scared about the arrest warrant for an unpaid traffic violation
A woman I used to work with was pregnant and cuffed by police...It was a mistake...On the news and everything...Let me see if I can find the article.

the law is the law. If you make 1 exception, where do you draw the line? Do suspects always need handcuffs though? I'm not sure if that is proceedure, or if they have the option. If that's not a must, I think they could have skipped it, since they could have out run her, but they should have arrested her, b/ c there was a warrant.
I just didn't know they issued warrants for 1 unpaid parking ticket.

DLWDLG: I heard about that kid and laughed my butt off. She deserved it. You commit a crime you pay for it. That little girl needed to learn you can't steal. Just saying 'bad girl' wouldnt have been as effective as putting her in handcuffs and sticking her in the back of a car.
This old lady shouldnt have been on the road and that has NOTHING to do with her AGE. If it was me on that road they'd have taken me in just as easily and I'd have expected them to.
Blaming the cops here is just so sad. They were doing their job.

I am a little torn. I mean the PO were just doing their jobs.. but I do feel bad that a woman her age had to be handcuffed and arrested for a traffic violation!! She must have been frightened.. jeez

It was a traffic ticket. It doesnt really say parking (i dont think) and in Texas it doesnt matter! You get a warrant it doesnt really say Why unless you're a danger, you're just get a warrant.
My ex fiance wouldnt leave me alone. He flaunted a new woman in my face and wouldnt give me back my key to my apt. So I called the cops (he told me to). They couldnt get my key but they DID however find a 1 year old warrant out for his arrest. For driving without insurance. Of course he HAD insurance on his car at the time he was arrested but they don't care. You got a warrant, youre arrested right there, no questions. Idiot guy.
Another guy I know well got arrest for an outstanding ticket he got for 'excessive speed' in a airport drop off area. He cop pulled us over in a BICYCLE For crying out loud! It was 2 years later when a small alteration occurred that they put his name in the computer and arrested him on the spot.
So whether it's speeding, parking, inspection, insurance.. whatever you get a ticket and ignore it, you get arrested. At least in Texas.
I don't know about here. Isn't it the same?

Did you notice one of her sons is a state district judge...LOL
Absolutely, she should have been arrested. The law is the law.
I don't think hand cuffs were necessary but they were going by the book

I personally think they could have just asked her to sit in the back. I don't think the handcuffs were necessary. She is 97 years old, at 97 pulling her arm behind her back to cuff her could have broken it. All I can think of is my grandmother and if this were done to her. At the end of her life she was sooo brittle, if she was moved one bit she broke something. I think they could have done without the cuffs, I doubt she was going to take off running!!

I dont think she would have gotten too far if she hadnt been handcuffed...But I don't know that 97 year olds should be driving....Reflexes are so much slower at that age...

I don't think handcuffing an elderly lady is right.. unless she's into kink.. haha
Just kidding!
Seriously.. an elderly lady is not going to run away or anything.. treat her with respect.. I would have just asked her to sit in the back.

Re: Poll: Was it inappropriate? Handcuffing and arresting a 97 yr old woman?
I think Handcuffing her is going too far, at 97 there is no way she could have gotten away and thats the basis for the handcuffs! Also as far as saying whats good for one person is as good as another, thats a bunch of crap when it comes to cops and the LAW...A few years ago I WAS BROKE...and I was drving to work an uninspected, unregistered car for about 4 months, I got pulled over 3 times b/c cops noticed the sticker ( color was an old one) the first two let me off scott free...not one ticket, third guy gave me tickets so whats the fairness in that?? Had she not had the ticket outstanding they would have let her go Im sure...
