No, we are not having one. Neither one of us have enough money to have to worry about that anyway!
Sorry I can't help.

Nope. I feel prenuptual agreements are based onthe fact that your marraige ay not last. If you are thinking it may not last, then it won't and so what is the point.
But that's just my opinion.

I respect your opinion, but I don't agree with it at all. I brought up having my FH sign one and he felt the same way, that it was a jinx on the marriage. The thing is, my father has worked very hard in his life and what he's built up should stay only with the family. I have no doubts that my marriage will last (we've already been together for 9 years), but I'm no fortune teller and there's no way to know for sure what will happen in the future. Since FH got upset with the suggestion, I have had my parents write in their will exactly what they want done with their money and property and they have written that in the event of divorce, none of their money could go to me or my sister's ex. Think of it this way... for whatever reason you and FH gt divorced and he remarries. Would you want the money your parents worked so hard for to go towards your ex's new childrens college fund? Would you want your money to buy his new wife a car? Unfortunately, that's the reality of things and you need to cover all bases.

Re: Pre-nups?
I'm not having a pre-nup, but I can understand why if it is dealing with money that your parents have worked very hard for.
I also think it depends on the situation of where a pre-nup is appropriate. For me, there's nothing of mine that I wouldn't give.
If it is a second marriage, I can understand if there were kids involved. For example, I know someone who just remarried and wanted a prenup so that his children got what he worked for his entire life in case he passed or got divorced, that his 2nd wife wouldn't take all of it.

Re: Pre-nups?
We are definitely having a pre-nup - even though we have been together for 5 years - and there is no doubt - I have found my soulmate. We each own a condo and have substantial assests - retirement accounts, stocks, etc. I love him dearly, but if something happened to either of us before we have our own family I would want my assests to go to my neices and nephews and his assests to go to his family. I realize a pre-nup is not romantic - but it is IMO the smart thing to do. How many couples do you know who were divorced and fought over money???

Re: Pre-nups?
I don't know where you guys live, but nowhere in the law does it state that upon divorce, your husband has a right to your parents property. So I don't understand the concern there. I guess if you are talking aboutt their property getting passed down to you. If that is the case, then a will can solve those issues.
Also, about 90% of people who have pre-nups wind up divorced. So you are going to tell me that a pre-nup doesn't affect a marraige?
Well, it doesn't matter because it's just my opinion.

It has to do with estate inheritance. Myt Uncle is a lawyer, and a will does not always cover the issue after the fact.

I believe (from my parent's divorce) all assets are divided 50/50, and then alimony decided. So, say your parents passed away and left you their house, and $200,000, you would have to split the $ and the value of the house (either buy out his share or sell the house and split the cash value). So this isn't an issue if the parents are living, but if they passed away while the marriage was intact the husband would be entitled to 1/2 of the assets left to the parent's daughter (wife) in their will.

Re: Pre-nups?
I think if you have substantial assets then maybe it is a good idea. Also I think maybe you can consider somethings, like was this person there with you when you had nothing (or at least before you became wealthier)? If they were there from the begining and you have a history together you may not have to worry if you were to divorce. But then again unfortunately you just never know.
I know we don't need one cause we are both broke as he!! But for other people it maybe the smart thing to do. Good Luck!!

.
Hmm....maybe that is true, but there may be other reasons behind this. Could we assume that more wealthy couples get prenups, and maybe these women feel they are more financially stable and able to leave a marriage than a woman who would not be able to support herself alone? Or, maybe rich men or women leave their spouses more often?

Re: Pre-nups?
you don't get a pre-nup unless one of you have soooooo much more money than the other (and you are worried about something)... like J-Lo... she is stupid if she doesn't get a pre-nup everytime she gets married
and no in the case of a parents estate there are loop- holes... husband does not necessarily get 50/50

Re: Pre-nups?
Well we have a house that's worth almost $500,000. Well, actually his mother owns the house. It will be passed to him after she dies. I have no part of it nor do I or will I ever have any access to it unless he gives it to me. That's it was set up ion her will. I don't know how, but that's how it was done.
But anyway, that is besides my point. My point is if you really think that there is ANY REMOTE POSSIBILITY that divorce is in your future, why get married? I guess I still see it as a jinx. But like I said, it's only my opinion. YOu guys can, and will, do what you feel is best for you. And that's all that matters.

Re: Pre-nups?
I started this post, so I should fess up.
My FI and I have a prenup. And I was curious if I was the only one with these issues and concerns.
FI actually insisted because he knew it would make my father happy and it would protect me. My parents were divorced, and my father worked hard to build up the inheritance he would pass on to me. He wanted to protect me. I'm an only child, so knowing he was dying with cancer, he was very concerned about this and FI thought this was the best way to handle it.
Basically, our prenup handles the ownership of our house which we bought last September, however, the entire downpayment and closing fees was from my accounts. FI felt it was not fair, and again wanted to protect me.
It also covers inheritance that either of us receive now or in the future. Both our father's passed away within the last year. FI inherited a nice nest egg. But being an only child, I inherited much more, and the pre-nup protects that property (and money) from being split 50/50 god forbid we were ever to break-up.

Re: Pre-nups?
We are not planning to break up, or get divorced. We are both committed to our relationship. We do not take our relationship lightly.
But we both came from broken homes and lets face it so are a lot of people.
It was a very difficult decision to make, like some of you pointed out, its almost like planning on breaking up. I do see your point of view.
Like I said, I was wondering if anyone else out there, was in my situation, or shared our opinions.

Re: Pre-nups?
All of you who have or are getting pre-nups, do you have wills? If not, don't ya think you should get those too?
