Process Servers R stoopid

Process Servers R stoopid

Sooooo since I suppose its only a matter of time until I get dragged into this I'll post about it...when I asked for prayers a little while ago for my MOH and I to stay out of something, it was so that we would not get served to give deposition in a case...

...If anyone remembers, like 5 years ago now I think...there was a guy who drove drunk the wrong way down the Meadowbrook and slammed into a limo coming back from a wedding...he killed the driver and a little girl. The drunk driver was a friend of mine and I was at the same party he was on the night he drove drunk. So now there is a civil case and they are looking to subpoena me to testify I guess.

So here comes the stupid part...the server came to my parents house last night. My Dad told the server that I didn't live there, and when the server asked if I was his daughter my dad told him it was none of his business and closed the door in his face (go dad!). So instead of finding another way to serve me lawfully, he instead slips the supoena under my mom's windshield wiper and leaves. So today my mom sent it back to him certified mail with a note saying 'She doesn't live here, enjoy'.

Its funny right now...but I know soon they'll find me and I'll get served and I'll have to get dragged back down into this all over again...not fun. So I guess I'll take my kicks while I still can.

This was really long just to call a process server stupid haha

I remember that. Terrible story.
I guess you really have to do the right thing in this case, but it's definitely funny to see/witness moronic process servers!

I'm sure I'll be flamed for this, but a little girl was decapitated and you're concerned about testifying against your friend. He deserves a lot worse than what his sentence was.

Seriously, I went through a lot the first time around, it was really hard on me and all of my friends and I really thought I had finally put it behind me...and now its all coming back again. I have my own demons from that night and I had finally quieted them and now its all blowing up.

So please, keep your judgments to yourself.

Nassau County DA Kathleen Rice made that drunk driving case almost national news. I remember seeing the accident and after-math on TV and it was part of a '60 Minutes' documentary a few months ago. I know it seems like a pain to be dragged into this but the lawyers working on the civil case are dreading this much worse because they are forced to ask many of the same questions again...so I hate to say it, but as the subpoena was already served, there's no way out of this..That guy should go to pay the price for what he did to that poor family and that little girl.

i dont thik shes worried about testifying AGAINST her friend...i think it something she wants to put behind her...shes perfectly aware of what he did was wrong....

sorry you have to deal with this.

just a heads up, but the process server is allowed to leave a supoena at your last known residence. normally they wouldn't leave it on the windshield of a car but this is allowed. after three unsuccessful attempts the server is allowed to do what is called a 'nail & mail.' they leave one copy at your last known residence & then will mail a copy via certified mail. this may be what he/she decided to do.

The supoena was NOT served. Under the law you have to either serve it to me or to a person deemed acceptable and responsible at either my place of business or my residence. Seeing as I don't live at my parents house and the didn't serve it to a person, just left it on a car...that's not legal service.

I agree.... as much as i have my own feelings about what happened that night, I have to stop and think how Ilana must feel for having to have all of this brought up again. That's what she's posting about, and I think it's better if we don't express our feelings on her friend. I am sure she's heard all of it a million times over.

Service of process is valid if its categorized under 'last known personal address' of the person being subpoena'ed.

they left it on a car windsheild... at the very least they should have left it in a mailbox, or taped it to the door!

Thank you <333 This is exactly it. Like I said earlier, it was really difficult to go through the first time and I have a LOT of demons about that night, including an irrational feeling of personal responsibility...it took a long time to get to the point where I could live life normally and not thinking about it every day and now that's gone and its all coming back.
