Question for teachers/others mandated to report abuse...

So, every wednesday i go to a pool hall here in va, and for the last 2 there was a obviously pregnant woman (about 5 or 6 months i would guess) smoking and drinking (though, i did not actually witness the smoking this week - with the cloud that was in the bar - she may have well been).

My FH and everyone is his program had a discussion in class and they were told if they were licensed that they had to call the police to report it.

Does this count as a form of child abuse? Am I mandaded to call since i'm a licensed teacher?

I mean, I know that this is really awful, but I wasn't sure if I were legally obligated to report it?

I would say no. However, you might want to call the bar and complain since they are the ones serving her.

I'd say no b/c it is not INside the school. However, I think you would feel better if you did or else make a comment to the bar owner.

No, even if it's wrong and you don't agree with her behavoir it's really none of your business.

The thing is, as a licensed teacher I'm mandated by the state to report abuse, so it kind of is my business

And also, it doesn't matter where it is, in the school, in the mall, i'm still mandated.

I was just uncertain if it was considered a form of child abuse.

This is not defined as child abuse. It's not responsible behavior but not child abuse. When I was pregnant I smoked I'm not proud of it. But before I was pregnant I smoked 2 1/2 packs a day and I cut down to 3 to 6 ciggs a day which is huge. My Dr knew that I smoked and actually said that quitting all together might be to much of a shock to my system. He was very lax about stuff. Now I wasn't out in the bar or drinking, but I really don't think there is anything you can do about it, it's not defined as child abuse it's just very poor judgment.

See, that's what i was thinking, but i became unsure when my FH's professor told him otherwise. (FH is not mandated, but will be in 2 years when he graduates and becomes a licensed school psychologist).

It's not considered legal child abuse because it is a fetus.

For example, this is how they got Roe v. Wade passed many years ago. Sarah Weddington, the lawyer for the defendant, argued (at the tender age of 22 I might add) that there was no precedent on record of a judgement in respect to a fetus. For example, if a pregnant woman was in a car acccident with two additional children in the car and all were injured a lawsuit could only be filed on behalf of the woman and two children because fetuses are not protected by the constitution. It goes back to the legal believe that life begins at birth.

I do agree with you, however, not responsible behavior on the part of the mother.

You can always make a call anonymously. If ever you're not quite sure, make the call. They will tell you whether or not it is a case to be looked into further.
