Ok girls - i have a few questions about the band contract. FH and I received it this weekend and no way are we going to sign it the way it was sent -
First - it doesnt say anything about what happnens in case a member of the band cant perform - This is the contract term -
This Agreement is subject to 'BAND's' proven inability to perform due to Acts of God, Accidents, or any other legitimate conditions beyond the control of the performers. Liability for 'BAND'S' non-performance is limited to the value of this contract as stated above.
Ok - i understand the acts of gods and accidents - but otehr legitimate conditions - who decides that?? And does that mean I am stuck without a band? That cant be right...
Second - they contract says that the band is contracting to perform in a safe and secure enviroment free of looting and that I am responsible for any damage done by my guests -
Is that right? Does anyone elses contract say that? Also - how am I supposed to know if someone decides to crash my wedding and riot - it makes no sense that I would be responsible for that -
Lastly - the contract states that FH and I are contracting that the hall will have an adequate supply of electricity for equipment used -
Isnt that the halls responsibility - i mean obviously this can be easily fixed by my calling the hall and asking them for their usage capacity and then verifying it with the band - but how can the non-performance due to this be our responsibility -
I'm just looking for a fair contract - and it doesnt seem that way -
How is everyone else's contracts regarding these issues?

I don't have anything to say about your contract...but I think that's the lawyer in you showing! My brother is a lawyer and when I asked him about the catering hall contract, he said that it was mostly standard and not to worry about it. Good luck!!

No, you are correct, you need to consider this... Our letter of agreement states: 'In case of injury or illness, and at my sole discretion, I reserve the right to replace any member of my group to ensure the quality of performers you have requested. '
So it becomes the band leaders problem, not mine...

We don't have that in our band contract, but our reception hall states that if our vendors do not have insurance coverage it's our problem. Pretty much everything is our problem with respect to them. I am going to look into wedding insurance to handle this.

Our letter of agreement states: 'As agreed, I will provide the following equipment: all musical equipment, PA system, recorded music during breaks; and you will provide the following equipment: sheltered playing area, electrical power. '
If you are worried about power supply, have your vendors talk to each other and work it out. Document for yourself that a conversation was held and go ahead was given, in my opinion you can't expect to be held responsible for anything more than that...again, here's where wedding insurance may come in...
It's very confusing and I still don't feel 100% comfortable with everything myself. You do the best you can and hope all else falls into place. If you forget something, you can always renegotiate.

Re: Questions about Music Band Contracts -
I know some people go so far to request the names of individuals who would be called upon in case something happens. I was okay with the band leader stating he would ensure the quality. The band was recommended by a friend of my FSIL who could not stop singing their praises. She had them at her wedding and had no problems, so I'm going into this with a different comfort level from the get go.

Re: Questions about Music Band Contracts -
I don't think I would sign a contract with those terms - Ours had something to the effect that they could substitute etc.... But I don't have our (my father is an attorney and since her deals with contracts everday and is paying I let him deal with the contract terms)
Most vendors I did notice have some sort of liability clause in there if they can't perform due to act of god etc.
If this is the band your heart is set on I would talk to them about maybe changing some of the terms - I did do this with some of my vendors and most were HAPPY to do this to make us happy.
You are paying a lot for a band and should be comfortable with everything before you sign. If they are not willing to talk to you about the contract I would consider if you can live with the terms or if this a vendor you want to use.
Good luck!
