My friend recently broke off her engagement, and her ex-FH is a lawyer and told her he would sue if she didn't give it back because its not a 'gift' ever, its something that is given under the pretense that marriage would follow, and if it doesn't then legally they have to give it back. Not sure if this is true or not, maybe the lawyer ladies can answer it better!

legally speaking, the status of an engagement ring changes after the wedding. before the wedding, it is supposed to go back to the giver. after a divorce, it is usually the recipient's to keep. this is based on NY law, CA law might be different.

this!

she had added a clause in her prenup that she could buy the ring back if the marriage were to disolve.
(had she not added that thought she would have been able to keep the ring for free, but who knows if they were already anticipating breaking up before the wedding!)
anywho - i wouldn't want to keep the ring, because of the bad memories involved with it...then again, i wouldn' tmind having my old wedding rign to sell the diamond (and with the price of gold what it is now-a-days!) and cash in on it

If she added this on her prenup, then what's the big drama. Buy or give back the ring..

i don't get why you would want to even buy the ring? Wouldn't that scream out FAILED MARRIAGE to you???

exactly..she wants it cause its all about the money to her...if you watched the proposal she looked at the ring first then said yes even dh was like wow she had to look at the ring first what a biatch...so she wants it to cash in not for memories...lets face it she never loved him she loved the idea of having a big fancy wedding

i never saw the proposal but that's pretty funny that even your DH noticed it. now that's just plain GREEDY - as if she doesn't have enough $

Re: Should she give back the ring?

she put a clause in the prenup that if they divorced she could buy the ring off of him in order to keep it..... so her trying to keep it without paying based on her mom saying he shouldn't be an 'indian giver' breaks goes against their lawful agreement..... you can bet that she would never let him go against something that would protect her money in that prenup!
