Is being appealed!!!! A judge signed a preliminary injunction preventing the county from enforcing their smoking ban, pending future trials.
AGHHHHHHHH! Just when it was FINALLY nice to go out and not coming home all gross and smelly!

Re: Smoking Ban in Nassau...
Im on the other side of this...I am happy.. poor business owners are SUFFERING because of this ban. I smoke and I like being able to go to a bar and light up if I want to. Resturants is a different story, I always sit in NON Smoking because they lock the smokers in a non ventalted tunnel and its sickning to sit in there..

Re: Smoking Ban in Nassau...
I'm totally for an appeal! It makes no difference to me, because nowadays I just have friends over all the time - we save $$ and get to smoke. But, I do feel bad for all the businesses that lose out. There are so many others like me who just opt to stay home. Just for the record, I agree that it gets gross in bars after awhile when everyone is smoking, but I disagree with government telling a business owner what he should/should not allow on his property. Smoking is legal, therefore private businesses should be allowed to decide for themselves whether they want to operate smoking or non-smoking establishments. If they are going to make it illegal to smoke anywhere, I wish they would just make cigarettes illegal and end the nonsense!

What about when the state law goes into effect next month? Then it will be back to non-smoking.
Suzanne, I'm like you. I enjoy a cigarette with a drink. I always sit in the non-smoking section of restaurants.

Re: Smoking Ban in Nassau...
Further to Demetra's point, what bothers me the most about the law most is that the bar owners and their employees are the ones with the responsibility and expense of enforcing a law doing damage to their business.
They now have to watch their customers comings and goings - leaving money on the bar, walking out on their check, sneaking cigarettes in the bathrooms, walking outside with drinks, noise out side their establishment and littering.

The ban has deterred people from going out?? I haven't come across that... Bars and clubs are still packed.

it works in california, theres no reason it can't work here. I still see plenty of people at the bars too.

Thats the one thing i hated about california, was that when you smoked people gave you seriously bad looks...and it wasnt inside!!

Yes it does work in California but note they have a lot more outdoor bars/cafes/decks. The upstate bars are especially upset about this b/c how can you expect someone to go outside in buffalo in feb for a smoke?
my cousin owns a bar in the city and his business has suffered tremedously. I am neither an opponent or supporter of the ban, I think there are good points for each side. I just wish they'd figure it out already and stop flip-flopping!

THANK-GOD!! I wish they did it before my wedding!! But, I 'm happy to hear it. Especially with the raining weekends & they expect people to go outside & smoke!! One bar my husband & I go to hasn't really listened to the ban. So we've been going there so he can smoke.

Re: Smoking Ban in Nassau...
Unless i read wrong, it says that a statewide ban is going into effect july 23rd. So this ruling will be moot anyway! (is that right?)

Re: Smoking Ban in Nassau...
That's what I thought but DH said that who ever is fighting that one too.
Demetra and Christine!! I totally agree with you..
this ban was COMPLETELY against capitalism...the idea of supply and demand (a concept we hold near and dear to our country's foundations) says...if people who drink demand to smoke...they should be able to smoke...
if non-smoking bars worked...bar owners would have their own non-smoking policies!!! this happened in restaurants BEFORE the ban...they would have a sign that said...this is a non-smoking establishment...
I know it s*cks to smell like smoke...but s*ucks worse to have your rights taken away...
