So FH called the original RH (FM me if you want the name) that we booked at 2 years ago and cancelled one year ago. It is located in suffolk county.
We left a $500 deposit that we were told we could not get back until someone else booked the date. Well the date is Sept 21, 2008 (less then 2 months) and it isn't booked yet. We are constantly calling to see if it has been booked and they always tell us no.
Then when we heard that in Suffolk there is a law that supercedes the contract of the RH we decided to call again. FH told them that he knew that they were legally allowed to keep $100 but that we should get our other $400. We were given the run around and when finally he got on the phone with the manager FH was told 'that's just now how we do it here. You gave $500 some people have lost $6500 that is not how our hall is run.' So FH said he would talk to some people and get back to him. Now I am pissed because isn't it the law? And this place is so gorgeous that I don't want to bad mouth them but ***!

Look, the law overides catering hall policy. it doesnt matter how much other people lost. they are operating illegally. call and threaten to report them to the better business bureo (sp?). tell them that you know their rights and, under this law, they can be sued if they dont refund the money promptly.

the only thing that i worry about with the law is that everything needs to be documented and dated as it happens with cancelling.. unfortunately if you are just starting the process now it might not be worth the headache for $400.. if it was over $1000 i would have an issue but you may have missed the deadline.. i think you are supposed to certify mail them etc.. atleast 6 months before the wedding date......

It ***** because we cancelled February 07. But we never documented anything. I mean I would imagine that they write down a date in their book when it was cancelled- but I am sure they wouldn't tell us. This is frustrating... are they so desperate for money that they need my $400. Isn't that pretty stubborn of a reception hall that charge $90/pp on Sunday!

Hmmm... I would say find out DEFINITELY about this law. Don't go by heresay. Once you have a copy of the law and have spoken to someone 'official' about it (get their name) then contact the RH. Are you sure they're not booked for your original date either? They could just be saying that..

I had a friend call and pretend that she wanted the date. They told her that it was still open. We did find a copy of the law on the internet. But he is still not budging.

You can bring them to small claims court. It is only $35 I think and then you can get the rest of your money back. As long as you are postive it is the law then there is nothing they can do about it. Good luck!

If I remember correctly you would have had to do this 6 months prior, the law revolves around the thought that the RH can rebook within 6 months, if you have in writing that you cancelled back in February you may be able to do something.
Here is a link to the law, not sure if its going to open up to the right page, if not its Chapter 237. You can hit the Next button and it talks more on the law
(1)If a consumer cancels a catering contract and the caterer is able to rebook the date, the caterer's cancellation fee may not exceed 5% of the total contract price or $100, whichever is less, plus actual expenses reasonably incurred.
(2)If a consumer cancels a catering contract and the caterer is unable to rebook the date, the caterer's cancellation fee may not exceed the difference between the total contract price and the cost of performance, plus actual expenses reasonably incurred. The caterer must be able to show diligent efforts to rebook and most fairly calculate the cost of performance.
(3)It will be presumed that a caterer who receives notice of cancellation six months or more before the scheduled date of the function will be able to rebook.

that is horrible. $400 is $400 no matter how you look at it so i hope u do continue to press the issue. if the place is so reputable they should not be worried over losing $400..aww what a shame. good luck

Hey, I told your FH that I would go with him and demand to see a copy of your contract. For their own protection, I would imagine that they would keep a copy of your cancellation in their records. If they don't have something in writing, then don't they owe you a party? Idk, just sounds shifty to me...I hope she faxes the letter to him tomorrow...keep me posted...
